The framework contract is for works in relation to asbestos containing materials (ACM’s) within the Council’s housing stock in the Falkirk Council area and shall include but is not limited to:
— the carrying out of management and refurbishment/demolition surveys to properties of various apartment sizes, communal areas, stairwells and other building elements such as soffits, roofing etc,
— the logging of information and findings to Falkirk Council’s asbestos database. Information provided by successful contractors must provide findings which must be able to integrate with Falkirk Councils asbestos database. Sample sheet of summary findings included in tender package (this will be provided in due course),
— the removal of various ACM’s as detailed in findings from surveys carried out,
— the repair and encapsulating damaged areas of ACM’s,
— the disposal of ACM’s in full accordance with SEPA requirements,
— carrying out of air testing and provision of relevant certificates.
All works carried out in relation to framework contract to be in full compliance of Control of Asbestos Regulations 2006, The Survey Guide HSG264, SEPA requirements etc all as detailed within Operational Issues below.

VI.4.2)Lodging of appeals
Precise information on deadline(s) for lodging appeals: Falkirk Council will incorporate a minimum of 10 calendar day standstill period at the point of information on the award of the contract is communicated to tenderers. This period allows unsuccessful tenderers to seek further debriefing from the contracting authority before the contract is entered into. Applicants have 2 working days from the notification of the award decision to request additional debriefing and that information has to be provided a minimum of 3 working days before the expiry of the standstill period. Such additional information should be required from the address in point I.1) of the contract notice. If an appeal regarding the award of contract has not been successfully resolved The Public Contracts (Scotland) Regulations 2006 (SSI 2006 No 1) provide for aggrieved parties who have been harmed or are at risk of harm by a breach of the rule to take action in the Sheriff Court or Court of Session. Any such action must be brought promptly (generally within 3 months). Where a contract has not been entered into the Court may order the setting aside of the award decision or order the authority to amend any document and may award damages. If the contract has been entered into the Court may only award damages.
