This contract is for full time air monitoring during licensed removal works, four stage clearance works and refurbishment and demolition surveys the reports of which are to be supplied in a format laid down by the County Council. A small number of management surveys will also need to be undertaken again to be reported in the County Council format. Arrangements for an emergency response will be required as part of the contract. The agreement value is potentially up to GBP 1 000 000 per annum over the maximum term of 4 years. The lower end of the value of GBP 200 000 per annum assumes the estimated spend for Staffordshire County Council only. This upper estimate of value includes an assumption of some of the services being purchased by other contracting authorities and Public Bodies, although there is no commitment at the time of tendering from any parties outside of SCC’s portfolio and this should be taken into consideration when bidding. The nature of the framework arrangement and potential range of beneficiaries (who may or may not take advantage of the framework) accounts for the range in the potential value of the framework agreement. Note that the framework may be used as part of a trading strategy.

It is a condition of this contract that all installation work is carried out by CHAS accredited fitters or equivalent. Failure to be CHAS accredited will lead to disqualification.
Submissions may be disqualified in the abscene of a Health and Safety policy where requried in law.
4 references are required as per the PQQ documentation. Failure to provide may lead to disqualification.
Disqualifiaction will occur if the submission is not willing to comply with the COSHH and DBS requirements.

The County Council currently as two service requirements in the area of Asbestos Tender PC440 (this tender) and PC439 Removal and Encapsulation of Asbestos containing material. Due to the need for independency of services, a bidder may bid for both tenders, however if successful the bidder will not be awarded both tenders. Further detail of award procedure under this situation will be included in the Invitation to Tender documents.

VI.4.2)Lodging of appeals

Precise information on deadline(s) for lodging appeals: The Contracting Authority will incorporate a minimum 10 calendar day standstill period (or 15 days where non-electronic or fax methods are used) at the point that an award decision notice is communicated to tenderers. The award decision notice will specify the criteria for the award of the contract/framework agreement, the reasons for the decision, including the characteristics and relative advantages, the name and score of the successful tender and will specify when the standstill period is expected to end or the date before which the contracting authority will not conclude the contract/framework agreement. If an appeal regarding the award of a contract/framework agreement has not been successfully resolved, the Public Contracts (Amendment) Regulations 2009 provide for aggrieved parties who have been harmed or are at risk of a breach of the rules to take action in the High Court (England, Wales and Northern Ireland). Any such action must be brought promptly (generally within 3 months). The Court may order the setting aside of the award decision or may order the Contracting Authority to amend any document and may award damages. If a framework agreement has been entered into the Court may make a declaration of ineffectiveness or may order that the duration of any relevant specific contract be shortened and additionally may award damages.
