This tender is for the provision of a Triage and Assessment Service under Deprivation of Liberties Safeguarding. The Contract will run for an initial period of 3 years from 1.4.2013 and will expire on 31.3.2016, with the option to extend for 1 additional renewal, for a period of up to 12 months.
The Health and Social Care Act 2012 requires local authorities to take over Supervisory Body responsibility for the assessment and review of Standard Authorisation under the Deprivation of Liberty Safeguards made by registered Hospitals from 1.4.2013. As a result Wirral Council will take over this responsibility from NHS Wirral, to provide an Assessment and Triage Service for individuals who are referred by a Managing Authority, which is a registered hospital under Schedule 1 of the Mental Capacity Act 2005 known as the Deprivation of Liberty Safeguards.
There are five Managing Authorities that are registered hospitals in Wirral being; Wirral University Teaching Hospital NHS Foundation Trust, Cheshire and Wirral Partnership NHS Foundation Trust, Clatterbridge Cancer Centre NHS Foundation Trust, Spire Murrayfield Hospital Wirral and Regency Lodge Heswall.
The key requirements of this Service are:
— to receive referrals from the Supervisory Body or directly from the Managing Authorities,
— be responsible for triaging Deprivation of Liberties Safeguards in compliance with the principles of least restriction and best interests,
— where required, ensure that statutory assessments, reviews and other requirements, as directed by the Supervisory Body and all legal requirements, are undertaken effectively,
— to comply with all recording and reporting arrangements as required by the Supervisory Body,
— to comply with the Mental Capacity Act and its regulations schedules, the Mental Capacity Act Code of Practice and Deprivation of Liberty Code of Code of Practice.
The Provider will have a proven track record in providing a Best Interest Assessment Service and will carry out assessments to a high standard inline with requirements as detailed in the section 1 of the Mental Capacity Act 2005.
This Service Specification requires Providers to demonstrate they are familiar with and have experience of service delivery as detailed within this specification in line with requirements of Schedule A1, Schedule 1A, and the Principals and workings of the Mental Capacity Act 2005. In December 2012 the Criminal Records Bureau (CRB) and the Independent Safeguarding Authority (ISA) will merge into the Disclosure and Barring Service (DBS). Further legislative changes will come into force during 2013 and 2014. The Provider must remain compliant with all current and subsequent changes in legislation and requirements from the start of this Contract.
This programme, as with other Council Services, may be affected by the Wirral wide budget consultation exercise. Therefore the final amount available per annum will range between 40 000 GBP to 45 000 GBP. The Council reserves the right to purchase the range and units of Services depending on priorities, funding and demand for Services.
