II.1.5)Short description of the contract or purchase(s)
Aviation Consultancy Services using a global aviation consultant for various Transport Scotland air related activities. It is intended that the services will be carried out predominantly for Transport Scotland on behalf of the Scottish Ministers. The services may comprise services in relation to the Scottish air transport market and infrastructure, including the improvement of national and international air connectivity and tourism opportunities through route development and other associated activities that assist in achieving the Scottish Ministers’ strategic aims for Scotland’s Economy and place in the world. The services may also comprise providing advice, recommendations and documentation in relation to policy,operations, regulations, technical specifications and procurement, which may include the procurement of new aircraft for a lifeline service.
It is anticipated that the Framework Agreement may be used by other Scottish Government organisations for Services relating to other Scottish air transport market and infrastructure related activities as required.

If the successful tenderer is a consortium, the Scottish Ministers shall require each consortium member to be jointly and severally liable pursuant to the Framework Agreement for Aviation Consultancy Services. The Scottish Ministers may require a consortium to form a legal entity before entering into the Framework Agreement for Aviation Consultancy Services.

Information and formalities necessary for evaluating if the requirements are met: Economic operators will be evaluated in accordance with the Public Contracts (Scotland) Regulations 2006, as amended, on the basis of information provided in response to a prequalification questionnaire (“PQQ”) which forms part of the Prequalification Document (refer to VI.3).

Transport Scotland, on behalf of the Scottish Ministers, will conduct the proposed procurement process for the Framework Agreement for Aviation Consultancy Services.
In the event of the conclusion of the framework agreement, the Framework Agreement for Aviation Consultancy Services will be entered into between the Scottish Ministers and the Successful Tenderer.

The Prequalification Document, which comprises the Prequalification Prospectus and the Economic Operator’s Prequalification Questionnaire, is provided as an attachment to this notice in both pdf and microsoft word format in the Additional Documents section within the Public Contracts Scotland portal (www.publiccontractsscotland.gov.uk).
Any economic operator wishing to request to participate in response to this notice is required to submit a completed PQQ in accordance with the Prequalification Document by the required date and time specified in IV.3.4.
The Scottish Ministers shall not evaluate any completed PQQs received past the specified submission deadline, unless the delay is caused by a situation outwith the control of the economic operator, the determination of such compliance shall be at the sole discretion of the Scottish Ministers.
Compliance with achieving the specified submission deadline shall be at the sole responsibility of the economic operator (including obtaining evidence of receipt by Transport Scotland on behalf of the Scottish Ministers).
Any economic operator which alters its composition after making a completed PQQ will be the subject of re-evaluation.
The Scottish Ministers reserve the right not to conclude any framework agreement as a result of the procurement process initiated by this notice and to make whatever changes the Scottish Ministers deem appropriate to the content, process, timing and structure of the procurement process.
Transport Scotland and the Scottish Ministers shall have no liability for any costs howsoever incurred by anyone participating in the pre-qualification and tender process.
Under Section II.3 of this notice, the anticipated “Duration of the Contract” is 4 years.
Economic operators should be aware that all information submitted to the Scottish Ministers may need to be disclosed and/or published by the Scottish Ministers in compliance with the Freedom of Information (Scotland) Act 2002 and the Environmental Information (Scotland) Regulations 2004.
The date referred to in paragraphs IV.3.5 of this notice is provisional.

Precise information on deadline(s) for lodging appeals: An economic operator that suffers, or risks suffering, loss or damage attributable to a breach of duty under the Public Contracts (Scotland) Regulations 2006 (SSI2006/1)(as amended) may bring proceedings in the Sheriff Court or the Court of Session. Economic Operators should refer to the Public Contracts (Scotland) Regulations 2006 (as amended) for information in relation to the lodging of appeals.
