The Hertfordshire Local Enterprise Partnership (LEP) are procuring for a provider to deliver the Get Enterprising — Start-up and early stage business support programme; a targeted programme of support to bolster and deepen the support currently available to start-up and early stage businesses in Hertfordshire. II.2.4)Description of the procurement:

The “Get Enterprising — Start-Up and Early Stage Business Support Programme” is a targeted programme of support to bolster and deepen the support currently available to start-up and early stage businesses in Hertfordshire. Beneficiaries of the support will be early stage businesses with the potential and appetite for growth, who may not yet have reached a state of commercial maturity or readiness to effectively utilise other forms of business support available in Hertfordshire. Hertfordshire’s business population is increasing on average by 3 000 businesses per year, the majority of these being new business starts that have different needs to those of mature businesses. Whilst Hertfordshire has both business start-up and Growth Hub services, these are not of a sufficient scale to address the significant gap in provision to connect these services. Essentially, bridging the 2 programmes with bespoke support for post launch businesses to firstly enable them to become resilient in their development phase and then seamlessly connect them to mainstream and scale-up provision — accessed through the Hertfordshire Growth Hub. This tender is to commission a provider to deliver this new connection service, on a 3 year contract term, from 1.4.2019 — “Get Enterprising — Start-Up and Early Stage Business Support Programme”. Therefore the objective of this contract to provide effective advisory support that will increase the number of businesses progressing towards a growth pathway and to provide an effective point of connection between existing start-up and mainstream business support services operating in Hertfordshire. The estimated total value of the Contract is stated in II.1.5) of this notice and is for the entire contract term. For the avoidance of doubt, the estimated annual value of the contract will be approximately 300 000 GBP. The contract will be awarded for the entirety of its term of three (3) years, with no extension options. Please note that the contract requirements will be subject to available financial resources, supplier performance and flexibility to meet changing demands.

The contract is therefore drafted such that the LEP Entity will be the contracting body, not the Council. Tenderers should note that all evaluation, clarification and award activity occurring on or after 1.4.2019 shall be carried out by or on behalf of the LEP Entity. Tenderers should further note that references to the Council in these instructions to tenderers and the response documents shall include references to the LEP Entity, as the context requires. Tenderers acknowledge that all rights and obligations of the Council set out in the instructions to tenderers and the response documents shall be rights and obligations of the new LEP Entity from 1.4.2019. The Contracting Authority will incorporate a minimum 10 calendar days (when using electronic means) standstill period at the point information on the award of the contract is communicated to tenderers. This period allows unsuccessful tenderers to challenge the decision to award a contract before a contract is executed/signed (as appropriate). The Public Contracts Regulations 2015 (“Regulations”) provide for aggrieved parties who have been harmed or at risk of harm by a breach of the rules to take action in the High Court (England, Wales and Northern Ireland). Any such action must be brought promptly and within the time limits as defined in the above regulations. Where a contract has not been entered into the court may order the setting aside of the award decision or order the Contracting Authority to amend any document and may award damages. If the contract has been entered into the court has the options to award damages and/or to shorten or order the contract ineffective.
