Cheshire East Borough Council is required to provide Applied Behaviour Analysis Therapy to a Year 12 pupil with a Statement of SEN. Part 3 of the Statement of SEN specifies that the provision of ABA Therapy will take place both in a special school and in a community setting with necessary support for training and consultancy.
The Statement of SEN sets out the additional provision needed to meet a child/ young person’s special educational needs and has been written with regard to the SEN Code of Practice which became effective from 1 January 2002. This statutory guidance relates to the following legislation:

    • the Education Act 1996 (as amended by SENDA 2001) Special Educational Needs and Disability Act 2001;
    • the Education (Special Educational Needs) (England) (Consolidation) Regulations 2001;
    • the Education (Special Educational Needs) (Provision of Information by local authorities) (England) Regulations 2001; and
    • the Education (Special Educational Needs) (Information) (England) Regulations 1999.

The Statements of SEN is reviewed every six months, in this case. The Statement of SEN states that the ABA Therapy will be provided for 40 hours per week, 50 week of the year. However, when full inclusion has been achieved, ABA will be reduced to 18 hours per week during term time and 30 hours per week during school holidays. The provision will be kept under review to reflect the gradual increase in inclusion into the school setting.
Statements of SEN cease at the end of the academic year when the pupil reaches the age of 19.
