The Council has identified three opportunity sites within this area, in the ownership of the Council and their public sector partners, and comprising a total of 2 453 ha (6.07 acres). Whilst these sites represent the currently envisaged opportunities, the Council would consider other innovative ways of delivering our objectives, including taking in adjoining land if it can be demonstrated that these solutions are deliverable.
The Council will be providing funds, up to a maximum target price, of circa 15 000 000 GBP for the delivery of the PSQ facility.
The Council has advanced the position with respect to land assembly with the other public sector land owners and is in detailed negotiations with the parties involved.
For example, heads of terms have been agreed with Hertfordshire County Council, whose Library Services and Registration, who will be located within the new PSQ facility, and whose land holding, together with the Council’s, is sufficient to accommodate the new PSQ facility.
The development partner will be required to deliver the PSQ facility against a number of project objectives that also include a range of minimum project requirements.
As well as the delivery of the PSQ, the development partner will also be expected to deliver a modern commercial leisure offer (such as cinema and food & beverage) and complementary regeneration comprising appropriate residential or commercial development.

The gross development value for the overall opportunity (including the PSQ) is anticipated to be in the order of 20 000 000 -25 000 000 GBP.

Following selection of the successful bidder after close of dialogue, the Council proposes to enter into a conditional development agreement with the preferred bidder. This will govern the parties’ responsibilities for the delivery of the PSQ and development of the remainder of the sites. During the initial dialogue (Outline Solutions) stage, draft heads of terms will be issued to short-listed bidders. Bidder specific detailed heads of terms and supporting documentation for incorporation in the development agreement will be agreed during dialogue at Detailed Solutions stage. In order to minimise bidder costs the draft development agreement will be issued following close of dialogue to the preferred bidder and finalised in accordance with the agreed detailed heads of terms and the preferred bidder’s final tender submission.
The Authority reserves the right to change without notice the procedure for awarding the contract, to reject all or any bids for the contract, to terminate the process and not to award a contract at any time without any liability on its part. No contract will be created between the Authority and any party until a contract is executed between the Authority and the winning bidder.
The Authority is not liable for any costs (including any third party costs fees or expenses) incurred by those expressing an interest in, negotiating or tendering for this contract opportunity.
Any agreement entered into will be governed by English law and will be subject to the exclusive jurisdiction of the English Courts.
