Information and formalities necessary for evaluating if the requirements are met: An economic operator will be ineligible for participation in the tender process where the contracting authority has actual knowledge that: – the operator or its directors or any other person who has powers of representation, decision or control of the economic operator has been convicted of any of the offences listed at regulation 23 paragraph 1 of the Public Contract regulations 2006 (but subject to paragraph 2 of this regulation) – any of the grounds set out at reukation 23 paragraph 4 of the Public Contract Regulation 2006 applies to the economic operator. An economic operator may be judged ineligible for participation in the tender process where: – economic operators responding to this notice shall provide written confirmation as to their status with respect to the matters set our in paragraph 1 and 4 on Regulation 23.
