Please note, this procurement process is not a regulated procurement under the Public Contracts Regulations 2006. The overall project, as well as qualifying for the BPRA scheme, is receiving ERDF (North-West Operational Programme 2007–2013) and Chrysallis funding. In light of this funding, and in order to secure value for money, West Nile Developments Limited (WNDL) intends to follow a structured procurement process which mirrors the requirements of the Public Contracts Regulations 2006 to a certain extent to identify a contractor to carry out the project.
This procurement process relates to WNDL’s planned design and construction of the renovation, conversion and extension of the Watson Building, a Grade II listed building, on Renshaw Street, Liverpool to create a Grade A office facility. The property will be acquired by WNDL and the works will be funded though a Business Premises Refurbishment Allowance (BPRA) scheme. WNDL is a specific development/contracting company that has been set up to facilitate the project.
The project will deliver a total of 8,489 m² of gross internal area of which 6,764 m² will be net internal area. The extension will contain a gross internal area of 3,652 m². An additional floor level is being provided at roof level of the building. The exterior of the building is to be fully restored and internally certain heritage items are to preserved and incorporated into the works. The work will commence as soon as possible after the selection of the main contractor and practical completion is anticipated to be in August/September 2015. The project will be procured by way of an amended JCT Design and Build Contract, DB2011.
WNDL has applied for planning permission and listed building consent. Specific contractual requirements will be included in the ITT for the discharge of conditions attached to these permissions (once granted) and for the management of that process.

Information and formalities necessary for evaluating if the requirements are met: WNDL is electing to apply the conditions contained in Articles 45 to 50 of Directive 2004/18/EC and regulations 23 to 25 of the Public Contracts Regulations 2006. WNDL has also set out such information within its Pre-Qualification Questionnaire, a copy of which can be obtained from the contact point at Section 1.1.
III.2.2)Economic and financial ability

Information and formalities necessary for evaluating if the requirements are met: A detailed Pre-Qualification Questionnaire (PQQ) will be available to all Candidates who register an interest in this opportunity. However, all Candidates registering should review the minimum standards set out in this contract notice and ensure that they are able to satisfy these before registering and requesting a PQQ.
WNDL is electing to apply the conditions contained in Article 47 of Directive 2004/18/EC and regulation 24 of the Public Contracts Regulations 2006. As such, the following requirements shall be included in the PQQ and shall be assessed by WNDL:
(1) All Candidates will be required to provide a reference from their bank.
(2) All Candidates will be required to provide evidence of relevant professional indemnity insurance, public liability insurance and employers’ liability insurance.
(3) All Candidates will be required to provide a statement, covering the 3 previous financial years including the overall turnover of the Candidate.
(4) All Candidates will be required to provide statements of accounts or extracts from those accounts relating to their business.
Minimum level(s) of standards possibly required: Candidates must be able to demonstrate that they can satisfy the minimum standards set out in this contract notice. Candidates which cannot satisfy the following minimum standards will not be invited to tender:
— have a turnover of at least 40,000,000 GBP for the last 3 financial years;
— have an annual profit of at least 2,000,000 GBP for the last 3 financial years;
— have Professional indemnity insurance cover of 10,000,000 GBP;
— have Employers Liability insurance of 50,000,000 GBP;
— have Public Liability insurance if 50,000,000 GBP;
— be able to offer, if required, an acceptable Parent Company Guarantee failing which an adequate Performance Bond will be required.

WNDL reserves the right not to award any or part of this contract. All dates, values and time periods specified in this notice are provisional only and WNDL reserves the right to change these.
WNDL shall not be responsible for any costs, charges or expenses incurred by bidders and accepts no liability for any costs, charges or expenses, irrespective of the outcome of the competition, or if the competition is cancelled or postponed.
The Pre-Qualification Questionnaire is the only method by which WNDL will accept requests to participate. The PQQ can be obtained from the contact point in section I.1.
In respect of section II.1.9, please note that variant bids may be accepted by WNDL provided that their form and nature are approved by WNDL in advance.
For the avoidance of doubt, WNDL is not a contracting authority for the purposes of the Public Contracts Regulations 2006. This notice is published on a voluntary basis to ensure effective competition, in light of the use by WNDL of ERDF (North-West Operational Programme 2007–2013) and Chrysalis funding being used.
