Rehabilitation Programme
In May 2013, the MoJ published the ‘Transforming Rehabilitation: A strategy for reform’ (https://consult.justice.gov.uk/digital-communications/transforming-rehabilitation/results/transforming-rehabilitation-response.pdf).

This publication outlined the Government’s intended approach to driving down the rate of reoffending and delivering better value for the taxpayer through a programme of reform and extension of competition and payment by results within provision of probation services.
The Rehabilitation Programme involves the split of the current probation and offender resettlement services into a single national public probation service (National Probation Service (NPS)) and the setting up of a series of independently owned and operated Community Rehabilitation Companies (CRCs) which will deliver rehabilitation (probation and resettlement) services in 21 Contract Package Areas (CPAs) across England and Wales. The MoJ is seeking to transfer the delivery of these CRC services to independent Providers via the award of contracts to and sale of the CRCs.
Indicative contract length will be between seven (7) and ten (10) years with an option to extend for a further period of three (3) years.

II.1.6)Common procurement vocabulary (CPV)

75230000, 75100000, 75240000, 80400000, 80500000, 85100000, 85300000

II.1.7)Information about Government Procurement Agreement (GPA)

The contract is covered by the Government Procurement Agreement (GPA): yes
II.1.8)Lots

This contract is divided into lots: yes
Tenders may be submitted for one or more lots
II.1.9)Information about variants

Variants will be accepted: yes
II.2)Quantity or scope of the contract
II.2.1)Total quantity or scope:

The CRCs will manage in scope offenders in the community (generally, those assessed as posing low or medium risk of serious harm to the public) and will have flexibility to deliver innovative rehabilitative support. They will deliver the sentence of the court or post-custody licence/supervision for each offender allocated to them, and will seek to rehabilitate offenders and reduce reoffending. A proportion of their payment for doing so will be dependent on their performance in reducing reoffending.
CRCs’ caseload will fall into two broad categories: offenders released from custody on a licence/supervision period; and offenders subject to Community Orders or Suspended Sentence Orders.
Intended changes to the sentencing framework, and to supervision/licence arrangements for offenders released from custody are being introduced in the Offender Rehabilitation Bill, currently before parliament.
Offenders released from custody will generally be subject to licence or supervision conditions, including, subject to the passage of the Offender Rehabilitation Bill, those given short custodial sentences, who are not currently subject to such requirements on release. This will give Providers a very wide discretion to require them to undertake rehabilitative activities.
Some community orders will in future, subject to the passage of the Offender Rehabilitation Bill, include a new Rehabilitation Activity Requirement, which will give Providers a similar wide discretion to stipulate rehabilitative activities.
Additionally, in support of the reforms, the National Offender Management Service (NOMS) are realigning the prison estate, designating a number of resettlement prisons for each CRC area (see information in Annex B), which will release the great majority of offenders into the area in which they have served the last three months of their sentence.
The CRCs will work in resettlement prisons allocated to their area, delivering a resettlement service for every offender before release. They will also have the opportunity to provide additional ‘through the gate’ rehabilitation support to drive reductions in reoffending.
CRCs’ flexibility to determine rehabilitative support, the ability to require offenders to undertake rehabilitative activities, and these new custodial arrangements provide the foundation for the CRCs to reduce reoffending.
CRCs will also be required to manage the risk of harm posed to the public by each offender they manage, including identifying any potential escalations to high risk and referring them to the new National Probation Service (NPS). They will be required to monitor and support offenders’ compliance with their sentence or licence conditions, and to take appropriate action in relation to any breaches, referring them to the NPS for court action or recall when necessary.
The NPS will provide advice to court on sentencing, will conduct risk assessments at the outset and determine the allocation of cases, and will manage offenders who pose a high risk of serious harm to the public or have committed the most serious offences. It will also respond to potential escalations in risk and take appropriate enforcement action in cases referred to it by the CRCs.
It is the intention that the contract length shall be between seven (7) and ten (10) years with an option to extend for a further period of three (3) years.
The ITN will provide further detail on the possible requirement for potential future (related) services from other Government Departments, including all Ministerial and non-Ministerial Departments, a list of which can be found at: https://www.gov.uk/government/organisations . Police and Crime Commissioners in England and Wales may also want to procure some limited similar rehabilitation services from their local CPA provider.

II.2.2)Information about options

Options: yes
Description of these options: The value basis presented should be considered as indicative only and for use only in relation to the financial and economic standing tests and contract award restrictions set out in the PQQ.
These figures are annual and based on steady state assumptions and 2013/14 prices. These figures reflect CPA volumes in 2011/12. Different volume baselines, commercial views and operating models could result in different contract values being awarded. These figures represent a possible total contract value inclusive of any payment that may be awarded for reductions in reoffending. Future annual contract values could be affected by changes to the requirement for services as well as the Provider’s operating models and workloads.
The intention is to have an option to extend for one set period of three years.
II.2.3)Information about renewals
II.3)Duration of the contract or time limit for completion

1. Procedure
This competition in relation to the Rehabilitation Programme concerns a mixed transaction containing Part B services and other elements. Although the Authority intends to run a process similar to the negotiated procedure, this is done on a voluntary basis and the MoJ reserves the right at any time without notice to depart from this procedure.
Information on variant bids will be provided in the ITN documentation.
All CPAs have identical Common Procurement Vocabulary (CPV) codes and therefore have not been repeated for each lot in Annex B.
2. Registration
Tier 1 Providers (Prime Contractors)
The MoJ will be running the competition through its eSourcing portal. The eSourcing portal is an online application that allows all Potential Bidders to create and submit their responses to any Requests for Information, Requests for Quotes or Requests for Proposals via the internet rather than in paper form (where they have been invited to respond).
To submit a registration request and gain access to the sourcing event, please send an email to rpprocurement@justice.gsi.gov.uk stating:

-Company Name
-Main Contact for Emptoris Communications
-Main Contact Email Address
-Sourcing Reference Number: 3190-2-Reducing Reoffending-RFI
The buyer will then contact you with the necessary details.
NB. The MoJ reserves the right to provide additional or new information only to registered Bidders.
Tier 2 & 3 Providers (Sub-contractors to the Prime Contractor)
There will be a seperate registration process for potential supply chain partners (Tier 2 and 3 Providers). To register, Tier 2 & 3 Providers should refer to www.justice.gov.uk/transforming-rehabilitation which contains further detail on the process to complete and return the registration form.

3. Competition data room
The MoJ will provide information relevant to the scope of the competition within a data room to assist Bidders in developing their bids.
4. Transparency
HM Government requires that tender documentation issued by Government departments for contracts with a value exceeding GBP 10,000 over the life of the contract are published online at www.online.contractsfinder.businesslink.gov.uk for the general public. The resulting contracts shall also be published.

The MoJ may use its discretion to redact information to protect key commercial interests on prescribed grounds. Therefore, Bidders who wish information not to be published if successful should secure agreement with the MoJ prior to submission.
Only documentation relating to awarded contracts will be published.
