The services that are to be provided under the framework agreement come within the service categories within the meaning of Article 21 and Annex IIB of Directive 2004/18/EC of the European Parliament and of the council of 31.3.2004 and as such are not subject to the full tendering requirements of Directive 2004/18/EC.
The contract will be awarded for an initial 4 years with an option to extend for a further 1 year, this will be excercised at the discretion of the Contracting Authority.
The Contracting Authority expressly reserves the right not to award any contract as a result of the procurement process commenced by publication of this notice.
Neither the contracting authority nor any person on whose behalf this procurement is undertaken is to be liable for any costs incurred by those expressing an interest or tendering for this agreement in any circumstances.
Participants should note that there will be no guaranteed volumes under this contract and the spend figures are indicative of previous spend per annum.

VI.4.2)Lodging of appeals

Precise information on deadline(s) for lodging appeals: The contracting authority will incorporate a minimum 10 calender day standstill period at the point information on the award of the contract is communicated to tenderers. If an appeal regarding the award of a contract has not been successfully resolved, the Public Contracts Regulations 2006 (SI 2006 NO 5) (as amended) provide for aggrieved parties who have been harmed or are at risk of harm by a breach of the rules to take action in the High Court (England, Wales, Northern Ireland). Any such action must be brought within 30 days beginning with the date when the economic operator first knew or ought to have known that grounds for starting proceedings had arisen. Where a contract has not been entered into, the Court may order the contracting authority to amend any document and may award damages. If the contract has been entered into the Court may only award damages or, where the contract award procedures have not been followed correctly, declare the contract to be ineffective.
