II.1.5)Short description of the contract or purchase(s)

The Scottish Government’s funding allocation to the Moray Affordable Housing Programme requires that a significant tranche of the 2015/2018 funding allocation is spent during 2015/2016. This means that the Council will be required to identify both “shovel ready” projects that can achieve site starts early in 2015 as well as projects that will start on site later in the programme. Where the development of proposals for sites are not at a sufficiently advanced stage to enable the submission of detailed design proposals and costings, the Council will consider land only submissions on the condition that future development contracts will be required to comply with detailed requirements set out in the ITT and that development costs are within benchmarks. The land purchase will be settled during the period 2015/2018, preferably during 2015/2016.

Should start on site between by early 2017 and should be completed by March 2018. The projects will be progressed on a design and build basis with developers providing an overall package of land and construction and design services. Each project will provide high quality energy efficient houses for affordable rent set within an attractive, sustainable and safe environment. Proposed sites should be capable of being delivered, taking account of planning requirements and land ownership, within the timescales required by the Council. The location of the sites is also not prescribed but the preference areas for investment are those where there are high levels of demand for affordable housing, specifically Elgin, Lossiemouth and Forres.

Evidence of site ownership. A search in the Sasine or Land Register brought down to within 2 weeks of the Tender Submission date will be sufficient; or
2. Evidence of contractual entitlement to obtaining ownership of the site(s) (a copy of the “concluded missives” with the owner) within 7 days of the date of the planning permission for the development.
This requirement will be a mandatory. If neither 1. or 2. are met then the Tender will be rejected by the Council. If either 1. of 2. are met then the Council intend to evaluate the evidence supplied as part of the evaluation process.
If criteria 2. is met, the Tenderer will require to submit evidence of ownership of the site(s) to the Council within 7 days of the date of planning permission for the development. If this not done then the Council will be entitled to reject their Tender at that stage.
