The Smart Metering Implementation Programme is voluntarily publishing this Contract Notice in the Official Journal of the European Union to advertise a competition to grant a licence for the Data and Communications Company subject to the Electricity & Gas (Smart Meters Licensable Activity) Order 2012, and the Electricity and Gas (Competitive Tenders for Smart Meter Communication Licences) Regulations 2012.
The Data and Communications Company will provide secure communications between energy suppliers, network operators and authorised third parties on the one hand, and compliant smart metering equipment in GB domestic premises and certain non-domestic premises on the other. The Licensee will operate and manage all of the DCC services, including acting as the contractual counterparty for separate communication and data service subcontractors, and acting as the contractual provider of services to its service users under a new regulated Smart Energy Code. Information on the DCC Licensing Competition can be obtained by registering on the DECC eTendering portal (www.decc.bravosolution.co.uk) and navigating to Open Access PQQs and then DCC Licence Qualification Questionnaire. This contains a draft version of the DCC licence, information on the application process, as well as the Qualification Questionnaire which firstly describes the opportunity, and secondly sets out the qualification criteria and response requirements for the first stage of the application process.

The licences will be awarded for an initial period of 12 years with an option to extend the contract up to a further 6 years to a total of 18 years maximum.

DECC expects that the DCC will be a discrete legal entity. The DCC Licence, once granted, will place rights, obligations and constraints on the licensed entity which prevent activities other than those permitted by the DCC Licence. The legal entity granted the DCC Licence will also be subject to regulation by Ofgem.

Description of particular conditions: DCC will be subject to a specific set of licence conditions which will include a requirement to comply with the future Smart Energy Code (SEC).
