Deployment of Broadband Networks in Nottinghamshire

Widespread and affordable access to superfast broadband to the people and businesses of Nottinghamshire is imperative to enable growth and innovation in all sectors of the community and to social and regional cohesion and a top priority for Nottinghamshire County Council (NCC) and its partners. It is acknowledged that the private sector will not always invest in areas where it may not be economically viable to do so and therefore NCC with funding from BDUK and other public sector sources is preparing to invest eight million five hundred thousand pounds sterling to ensure that there is equality in the provision of broadband across Nottinghamshire. However, NCC has to procure that such an injection of financial aid does not constitute illegal state aid and ensure that it complies with the Guidelines issued by the European Commission. To this end, NCC is undertaking this Open Market Review.
The purpose of the OMR is to enable NCC to definitively understand and map where private sector investment in broadband across the geographical area of Nottinghamshire has already been invested, is currently being made and is planned, without public sector intervention, for the next three years as a minimum and preferably up to 2020. NCC is interested in any current or planned investment by the private sector that will result in network infrastructure that is capable of delivering the objectives without State aid in order that NCC can concentrate on delivering these objectives in those areas where there is no current or planned investment by the private sector.
NCC is carrying out this OMR with private sector suppliers in compliance with the Guidelines. The information provided in response to this OMR by the private sector suppliers will help the Council determine where, in the absence of private sector investment, consideration should be given to the deployment of public funding. The responses will also be used as evidence that public funding is only being used in those areas permitted under the BDUK umbrella aid scheme for the state aid notification process. For both these reasons, the information provided by respondents needs to be robust and supported by detailed evidence.

This OMR is a formal request for information. The information provided will be used to support a notification to the EC for approval of State aid.
