II.1.5)Short description of the contract or purchase(s)

This Joint Procurement currently comprises the following individual Housing Associations; Oaklee Trinity Ltd, Ark Housing Association, South Ulster Housing Association Ltd, Ark Housing Association Ltd, Connswater Homes, Ulidia Housing Association and Helm Housing Association. These housing associations are responsible for procuring social housing project allocated by the Department for Social Development, this may also include other social and non social housing schemes and house/site purchase as they become available. The purpose of this joint procurement procedure is to appoint up to 2 framework agreements for the provision of Design Team Consultancy on new social housing projects allocated for the period April 2015 to March 2019/20 this may include other social and non social housing schemes and house/site purchase. Each framework agreement is to correspond to one of the following;
Lot 1 estimated construction value of less than 3 000 000 GBP.
Lot 2 estimated construction value of 3 000 000 GBP.
Separate competitions are being conducted in relation to each Lot, and economic operators are required to submit a separate Pre-Qualification Questionnaire and (if selected) a tender in respect of each Lot they wish to compete. Further details are provided in the specific Information Memorandum and Pre-Qualification Questionnaire relating to each Lot available from the contact point above.

Subject to the status and involvement of the parties, the Contracting Authority may require parties to commit to joint and several liability in respect of the contract. Alternatively the Contracting Authority may expect the lead operator to take total responsibility or to require a consortium to form a legal entity before entering into the contract. The Contracting Authority may require collateral warranties, parent company guarantees and/or performance bonds as applicable to be entered into by involved economic operators.

VI.3)Additional information

The cost of responding to the Pre-Qualification Questionnaire and any subsequent Invitation to Tender and participation in the procurement process generally will be borne solely by each economic operator participating. An Information Memorandum and Pre-Qualification Questionnaire is available in respect of each Lot from the contact point referred to in section I above.
Economic operators should note that the Contracting Authorities reserve the right to cancel this procurement process at any stage and not to award any Framework Agreement in respect of any 1 or more Lots. If the Contracting Authorities decide to enter into a Framework Agreement with the successful participant this does not mean that there is any guarantee of subsequent contracts being awarded. Any expenditure, work or effort undertaken prior to the contract award is at the sole risk of the economic operator participating in this procurement process.
It is envisaged that any orders placed under any Framework Agreement will form a separate contract under the scope of the Framework Agreement between the relevant economic operator and the particular Housing Association which is calling off services under that Framework Agreement. All discussion and correspondence will be deemed strictly ‘subject to contract’ until a formal contract is entered into. The formal contact shall not be binding until it has been signed and dated by the duly authorised representatives of the parties.
Any date given in Section IV above is a best estimate at the time of despatch. The housing associations reserve the right to extend any such date. Up-to 6 economic operators may be appointed to the Framework Agreement for each of the three lots advertised. The housing associations have the option of extending the 36 month initial term of the Framework by up to 12 further months. See sections II 1.4 and II 2.2 above.
