Through the Education Cloud Services Framework Procurement, SWGfL aims to procure a service to allow educational establishments within the UK to safely and efficiently procure ICT goods and services in a way that is tailored towards education sector needs, using hosted services and cloud services to deliver powerful ICT provision to educational establishments without the need for high levels of infrastructure, hardware and software, expertise and ongoing maintenance and management locally.
SWGfL will require its preferred provider to deliver a range of education focussed cloud services (further details of which are set out in the Descriptive Document which accompanies the Pre-Qualification Questionnaire) for educational establishments in the UK.

1. Any contract(s) entered into as a result of this notice shall be considered as a contract(s) made under English law and subject to the exclusive jurisdiction of the English courts.
2. SWGfL reserves the right not to enter into any agreement or award any contract as a result of this notice and to vary or change or not to proceed with this competition at any stage of the procurement process.
3. SWGfL shall not be responsible for any costs incurred by any applicant responding to this notice.
4. If any applicant considers that any information supplied by it is commercially sensitive or confidential in nature, this should be highlighted and the reasons for its sensitivity as well as the duration of that sensitivity specified. Applicants should be aware that even where they have indicated that information is commercially sensitive, SWGfL may disclose it pursuant to the Freedom of Information Act 2000 in response to a request where such disclosure is considered to be in the public interest. Please note that the receipt by SWGfL of any materials marked “confidential” or equivalent shall not be taken to mean that SWGfL accepts any duty of confidence by virtue of that marking.

SWGfL reserves the right at any time following the date of this notice to establish or procure the establishment of an entity (which may or may not constitute a contracting authority for the purposes of the Public Contracts Regulations 2006) in order to deliver the Project, including entering into any related agreement for the establishment of a framework with the successful applicant.
6. SWGfL reserves the right at any time following the date of this notice to make the Educational Cloud Services Framework Procurement available to other public sector bodies.
