Justification for a framework agreement, the duration of which exceeds four years: Due to the anticipated level of investment for the successful Provider of the site / service it would be disproportionate to establish the framework for the usual term of 4 years. As such and to make the service financially viable the term is for 10 years with initial breakpoint at year 4.

The Council wishes to let a lease for the School site and to transfer the provision of a combination of day, extended day, weekly, termly and 52 week residential placements for North Yorkshire County Council pupils at Foremost School (“the Services”) to a Provider through a Framework Contract. The lease and the Framework Contract will be separate but linked in that they are held by the same Provider.
The Framework Contract will enable the Council to commission placements on an individual basis for children and young people with behavioural, emotional and social difficulties (BESD). The value of this Framework Contract is up to 50,000,000 GBP over the contract duration.

The contract will commence on 24.10.2014 and will be for an initial term of 4 years to 23.10.2018, the Council will have the power to extend the contract for 2 periods of three years each at the discretion of the Council and subject to satisfactory performance. The potential contract length is 10 years (4 + 3 + 3). The value of this framework contract is up to 50,000,000 GBP over the contract duration. Excluding VAT.

VI.4.2)Lodging of appeals

Precise information on deadline(s) for lodging appeals: North Yorkshire County Council shall in accordance with the Public Contracts (amendment) Regulations 2009, incorporate a minimum 10 day standstill period commencing at the point that information on the intention to award the contract is sent to tenderers.
The Council shall, as soon as possible after the decision has been made, inform the tenderers and candidates of its decision,and shall do so by notice in writing by the most rapid means of communication practicable. The information will include:
a) the criteria for the award of the contract; b) the reasons for the decision;
c) the name of the economic operator to be awarded; d) a precise statement when the standstill period is expected to end.
Should additional information be required, please contact the person cited in paragraph I.1) of this form. If an appeal regarding the award of a contract has not been successfully resolved, Public Contracts Regulations 2006 (SI2006 No 5) provide for aggrieved parties who have been harmed or are at risk of harm by a breach of the rules to take action in the High Court (England, Wales and Northern Ireland). Any such action must be brought promptly (generally within 3 months).
Where a contract has not been entered into the court may order the setting aside of the award decision or order the authority to amend any document and may award damages. Following the 10 day standstill period,if no further debriefing has been requested, the court may only award damages once the contract has been entered into.
