Participants are advised that as legal services are a Part B service this is a voluntary OJEU notice and as such the tender is not subject to the full obligations under the Public Contracts Regulations 2006 (as amended) but is nonetheless subject to the general obligations of transparency, equal treatment and nondiscrimination.
The Contracting Authority is putting in place a framework agreement on behalf of the EM LawShare consortium. Information about the consortium is available in the tender documentation and information.
The Contracting Authority expressly reserves the right:
(i) Not to award any contract as a result of the procurement process commenced by publication of this notice; and
(ii) to make whatever changes it may see fit to the content and structure of the tendering competition, and in no circumstances will the Contracting Authority or any consortium member be liable for any costs incurred by the participants.
If the Contracting Authority decides to enter into a framework agreement with the sucessful suppliers this does not mean that there is any guarantee of subsequent contracts/orders being awarded, however the successful suppliers will be expected to provide added value services to the consortium (see tender documentation and information).
Any expenditure, work or effort undertaken prior to contract award is a matter soley for the commercial judgement of the particpants.
Any orders placed under this framework agreement will form a separate contract under the scope of the framework between the supplier and specific public body requesting the legal services.
Participants should note that there will be no guaranteed volumes under any framework agreement awarded.
The duration referenced in II.1.4 is for the placing of orders for legal services.
