Craven District Council;
Hambleton District Council;
Harrogate Borough Council;

Ryedale District Council;
Scarborough Borough Council;
Selby District Council.
Together referred to as the ‘Partnership’ with North Yorkshire County Council appointed to act as the lead in commissioning the Service.

II.2.1)Total quantity or scope:
The Service will provide fair and equitable services to vulnerable young people (16–25 year old) who may be experiencing difficulties with their housing situation, who are in transition from actual or threatened homelessness, or who are homeless or at risk of becoming homeless and have support needs, both as a result of their age and as a consequence of being unable to live with their own families or extended kin.
The successful tenderer will be able to deliver a countrywide service providing each element of the service as identified in the invitation to tender documentation. Tenderers will be able to bid for the service as a whole or submit consortia bids, however, they need to be confident that the aims and objectives of the service can be fully met.

Description of these options: The Contract will run between 1.4.2015 and 31.3.2018. The Council will have the power to extend the contract for a period of a further 2 years maximum at the discretion of the Council and subject to satisfactory performance.

III.2.1)Personal situation of economic operators, including requirements relating to enrolment on professional or trade registers
(a) is bankrupt or is being wound up, where his affairs are being administered by the court, where he has entered into an arrangement with creditors, where he has suspended business activities or is in any analogous situation arising from a similar procedure under national laws and regulations;
(b) is the subject of proceedings for a declaration of bankruptcy, for an order compulsory winding up the administration by the court or of an arrangement with creditors or of any other similar proceedings under national laws and regulations;
(c) has been convicted by a judgement which has the force of res judicata in accordance with the legal provisions of the country of any offence concerning his professional conduct;
(d) has been guilty of grave professional misconduct proven by any means which the contract authorities can demonstrate;

(i) has been the subject of a conviction for corruption, as defined in Article 3 of the Council Act of 26 May 1972 and Article 3(1) of Council Joint Action 98/742/JHA3 respectively;
(j)has been the subject of a conviction for fraud within the meaning of Article 1 of the Convention relating to the protection of the financial interests of the European Communities;
(k) has been the subject of a conviction for money laundering, as defined in Article 1 of Council Directive 91/308/EEC of 10 June 1991 on prevention of the use of the financial system for the purpose of money laundering.

VI.4.2)Lodging of appeals
Council shall in accordance with the Public Contracts (amendment) Regulations 2009, incorporate a minimum 10 day standstill period commencing at the point that information on the intention to award the contract is sent to tenderers.
The Council shall, as soon as possible after the decision has been made, inform the tenderers and candidates of its decision and shall do so by notice in writing by the most rapid means of communication practicable. The information will include:
a) the criteria for the award of the contract;
b) the reasons for the decision;
c) the name of the economic operator to be awarded;
d) a precise statement when the standstill period is expected to end.

If an appeal regarding the award of a contract has not been successfully resolved, Public Contracts Regulations 2006 (SI2006 No 5) provide for aggrieved parties who have been harmed or are at risk of harm by a breach of the rules to take action in the High Court (England, Wales and Northern Ireland).
Any such action must be brought promptly (generally within 3 months).
Where a contract has not been entered into the court may order the setting aside of the award decision or order the authority to amend any document and may award damages.
Following the 10 day standstill period, if no further debriefing has been requested, the court may only award damages once the contract has been entered into.
