Section II: Object of the concession
Main site or location of works Within the Greater London area.
The Contractor would be expected to build upon our existing successful projects and partnerships across the borough and in particular planned investment in our social housing stock managed.
The framework agreement also covers energy efficiency and carbon reduction activity funded from outside ECO that would be expected to be of mutual benefit. This could include, but is not limited to:
— Installing domestic energy efficiency measures funded from sources accessed by the Contractor, the Council or elsewhere.
— Providing market leading offers to ‘able to pay’ customers, including activity linked to the Green Deal.
— Energy and fuel poverty related advice services.
— Non-domestic energy efficiency works, for example on Council properties, schools, hostels and sheltered housing and so on.
— Promotion and installation of renewable technologies.

— The London Borough of Bexley and any registered social landlords with housing stock in Bexley.
— The London Borough of Bromley and any registered social landlords with housing stock in Bromley.
— The London Borough of Southwark and any registered social landlords with housing stock in Southwark.
— The London Borough of Greenwich and any registered social landlords with housing stock in Greenwich.
— South East London Housing Partnership (SELHP).
Should any Participating Authority decide to use the Framework Agreement each will enter into an Access Agreement with the Council and the Contractor which will allow each of the Participating Authorities to enter into a call-off contract under the Framework Agreement to enable them to have a direct relationship with the Contractor.

Section III: Legal, economic, financial and technical information
(a) is bankrupt or is being wound up, where its affairs are being administered by the court, where it has entered into an arrangement with creditors, where it has suspended business activities or is in any analogous situation arising from a similar procedure under national laws and regulations;
(b) is the subject of proceedings for a declaration of bankruptcy, for an order for compulsory winding up or administration by the court or of an arrangement with creditors or of any other similar proceedings under national laws and regulations;
(c) has been convicted by a judgment which has the force of res judicata in accordance with the legal provisions of the country of any offence concerning his professional conduct;
(d) has been guilty of grave professional misconduct proven by any means which the contracting authorities can demonstrate;
(e) has not fulfilled obligations relating to the payment of social security contributions in accordance with the legal provisions of the country in which he is established or with those of the country of the contracting authority;
(f) has not fulfilled obligations relating to the payment of taxes in accordance with the legal provisions of the country in which he is established or with those of the country of the contracting authority;
(g) is guilty of serious misrepresentation in supplying the information required under this Section or has not supplied such information;
(h) has been the subject of a conviction for participation in a criminal organisation, as defined in Article 2(1) of Council Joint Action 98/733/JHA;
(i) has been the subject of a conviction for corruption, as defined in Article 3 of the Council Act of 26.5.1997 and Article 3(1) of Council Joint Action 98/742/JHA respectively;
(j) has been the subject of a conviction for fraud within the meaning of Article 1 of the Convention relating to the protection of the financial interests of the European Communities;
(k) has been the subject of a conviction for money laundering, as defined in Article 1 of Council Directive 91/308/EC of 10.6.1991 on prevention of the use of the financial system for the purpose of money laundering.

Information and formalities necessary for evaluating if the requirements are met Economic and financial ability of economic operators will be based on the financial proposal submitted, and from an economic operator’s financial strength, financial capacity and financial risk. As part of this analysis, the Council may obtain a current financial assessment from its credit reference agency Dun & Bradstreet (http:// www.dnb.co.uk/). Economic operators will be assessed, amongst other matters, according to the level of risk stipulated by D&B. Any Economic Operator being given a higher than average (or worse) risk rating may be disqualified. Full details are in the Invitation To Tender (ITT) document.
