Precise information on deadline(s) for lodging appeals: East Thames Group will incorporate a minimum 10 calendar day standstill period (ref: alcatel case) at the point information regarding the award of the contract is communicated to the bidders in the process. this is to allow parties to apply to the courts to set aside the award decision prior to entering into a contract. applicants who are unsuccessful will be advised by etg of the decision and reasons why as soon as possible after the award has been made. if an appeal regarding the award of the contract has not been successfully resolved,the Public Contract Regulations 2006 (si 2006 no.5) provide for aggrieved parties who have been harmed or are at risk of harm by breach of the rules to take legal action, provided any such action is taken within the relevant limitation period. where no contract has been entered into, the court may order the setting aside of the award decision or award damages, and where a contract has been entered into the court may award damages, make a declaration of ineffectivemess, order a fine to be paid, and / or order the duration of the contract term to be shortened.
