Description of the contract
1. This review is part of an ongoing programme of work undertaken by the General Medical Council (GMC) to ensure that our fitness to practise procedures are fair, consistent and robust. This review will examine key aspects of our fitness to practise procedures in this respect. Specifically, it will:
a) explore the way in which the GMC present formal allegations to doctors,
b) consider whether the decisions made by our staff at key stages of our investigation process are consistent with the guidance provided to them to help them reach these decisions and, finally,
c) it will attempt to investigate the impact of this guidance itself.
2. A key question for this review is whether a) or c) may be a factor in the overrepresentation of any groups of doctors in our fitness to practise procedures.
3. It should be noted that this review encompasses only those parts of the fitness to practise procedures that the GMC is directly responsible for. This means the review will not consider the decision making that results in doctors being referred to the GMC or the decision making of the independent panels, which are supported by the Medical Practitioners Tribunal Service, which make decisions at interim orders panel or fitness to practise panel hearings.
