III.1.4)Objective rules and criteria for participation
The scope of services to be provided under this framework falls within the definition of social and other specific services in Schedule 3 to the Public Contracts (Scotland) Regulations 2015 (‘the Regulations’) and therefore the procurement process shall be subject to the requirements of section 7 of the Regulations. By virtue of Regulation 76(3) of the Regulations, bidders in any of the situations listed in Regulation 58 of the Regulations may be excluded. Any application of or reference to other Regulations unless clearly identified is not to be implied and should not be construed as applying any of the other Regulations to the procurement exercise or resulting framework, or bringing any of them into force.

Scotland Excel reserves the right not to exclude a bidder if at the Commencement Date (defined in the tender documents) the bidder has not obtained a grading of 4 or above for all quality themes at its most recent inspection, is yet to receive its first inspection, or has not completed the Registration process as a fostering service with the Scottish regulator of the service, provided that within 12 months of the Commencement Date, or other such period as reasonably determined by Scotland Excel,the bidder obtains confirmation of achievement of Registration and demonstrates to the satisfaction of Scotland Excel achievement of gradings of 4 or above or rating at grade 4 or above by the Care Inspectorate on all quality themes.

Scotland Excel is procuring this Framework Agreement on behalf of the organisations listed as participating in the Invitation to Tender.
Scotland Excel does not intend to include community benefit requirements in the contractual terms of this proposed Framework Agreement and Individual Placement Agreements made thereunder. In accordance with section 25(3) of the Procurement Reform (Scotland) Act 2014, the reasons are:
the diverse nature of the market.
Notwithstanding this,bidders will be invited to detail the community benefits they intend to provide relating to the Framework Agreement,and commitments will be monitored.
