II.1.5)Short description of the contract or purchase(s)

The contracting authority is seeking to establish the Framework Agreement as available also for use by or on behalf of public sector bodies in the West Midlands Region (and their statutory successors and organisations created as a result of re-organisation or organisational changes). These will include:
– Local Authorities i.e. a local authority as defined in Regulation 3(2) to (5) of the Public Contracts Regulations 2006.
– Integrated Transport Authority as defined by the Transport Act 2008
The Framework Agreement will cover the geographical region of the West Midlands and will comprise minor highway improvements through to large civil engineering capital schemes (e.g. Ring Road improvements). The works will comprise (and this is not an exhaustive list) of general highway and junction improvements, traffic signal installations, provision and installation of new signage, provision of bus and cycle lanes, improvements to existing and provision of new pedestrian crossings, carriageway and footway construction, public realm and environmental works, road and drainage construction, traffic management, temporary works, work to highway structures, stakeholder management, co-ordinating and undertaking utility diversions and connections and liaison with other contractors and developers, flood alleviation works and highway maintenance. In addition there may be a requirement for contractors to undertake part or the whole design of some works.

Description of particular conditions: When executing the contract in the UK the successful tenderer will be required to comply with the recommendations of the code of practice for the elimination of Racial Discrimination and the promotion of Equality of Opportunity in Employment published by the Commission for Racial Equality. The successful tenderer will be required to participate actively in the service related economic, social and environmental regeneration of the locality of and surrounding the place of delivery for the procurement. Accordingly, tender evaluation and contract performance conditions may relate in particular to social, economic and environmental considerations.

The Contracting authority will not be liable for any costs incurred by those expressing an interest in this contract opportunity. The contracting authority reserve the right to terminate the procurement process (or part of it), to change the basis of the procedures for the procurement process at any time, or to procure the contract by alternative means if it appears that the contract can be more advantageously procured by alternative means.
