The services subject of the procurement are LTR services within the meaning of Part 2, Chapter 3 of the Public Contracts Regulations 2015.

For Lots 1, 2, 3, 4, 5 and 6, MKC and MKCCG anticipates these contracts to operate like a framework agreement where MKC and MKCCG will allocate packages based on its requirements.

For Lots 1, 2, 3 and 4 a contract will be awarded to the bidders scoring the highest in accordance with the MEAT for the relevant zone. Three (3) bidders will be allocated to each zone. Each successful bidder will only be allocated to 1 zone. Evaluation will be in accordance with the published criteria with those bidders meeting the 60 % quality threshold then being evaluated on price; the evaluation panel will then consider the information provided regarding zone preference and will allocate successful bidders to a zone. Allocation to a zone is at the discretion of the Council. In each zone, work packages will be allocated on a rotational basis in alphabetical order.

Lot 5: For those bidders who meet the 60 % quality threshold there is no restriction on the number of Providers that the will be awarded a contract. Lot 5 work will be allocated on the basis of cheapest hourly rate first and then go up the scale as capacity requires.

Lot 6: For those bidders who meet the 60 % quality threshold there is no restriction on the number of Providers that the will be awarded a contract. Lot 6 work will be allocated on the basis of cheapest hourly rate first and then go up the scale as capacity requires, except where there is a need to match specific providers to children based on specialist skills.

For the purposes of Regulation 72(1)(a) of the Public Contracts Regulations 2015, MKC and MKCCG anticipate that during the term of the contracts awarded following this procurement, additional services may come into scope for provision under the contracts. The anticipated additional services are night provision, recuperation services and additional block capacity for winter pressures.

MKC and MKCCG reserve the right to run further mini competitions over the duration of the contract, under any of the Lots, for the provision of any parts of the services and for the provision of any of the additional services.

In relation to Lots 1, 2, 3 and 4 the Council reserves the right to re-open the tender and appoint other providers where the number of Service Providers in any zone falls to below three (3) for any reason.

The Council further reserves the right to increase the number of Service Providers in each zone or in any zone, to more than three (3) during the term of contract where this is necessary. Where the requirement to replace or increase number of providers occurs within the first year of the contract, the Council may make such replacement or additions by appointing from those bidders who participated in the original tender, met any specified requirements, but did not in the first instance rank in the top 3 bidders for the relevant zones.

There is no guarantee by MKC and CCG of any volume of work under the contracts awarded for this procurement.

Precise information on deadline(s) for review procedures:

Without prejudice to the remedies provided under Regulation 86 of the Public Contracts Regulations 2015, the Council of the Borough of Milton Keynes shall allow a period of at least 10 days to elapse between the date of despatch of its decision notifying its intention to award the contract and the date on which it proposes to enter into a contract. If by midnight at the end of second working day of the above said period the Contracting Authority receives a request in writing from an economic operator who had been sent a notice of being unsuccessful, the Authority shall inform the said economic operator of characteristics and relative advantages of the successful tender. That information shall be provided at least 3 working days before the end of aforesaid 10 days standstill period. Where it is not possible the standstill period shall be extended to allow at least 3 working days between provision of the information and the end of standstill period. Such additional information should be required from the address part l.1). If an economic operator is not satisfied with the information provided, the Public Contracts Regulations 2015 provide for aggrieved parties who have been harmed or are at risk of harm by a breach of the rules to take action in the High Court (England, Wales and Northern Ireland). Any such action must be brought promptly (generally within 3 months). Where a contract has not been entered into the Court may order the setting aside of the award decision or order the authority to amend any document and may award damages. If the contract has been entered into the Court may only award damages.
