This tender is for the provision of an Independent Mental Health Advocacy Service in Wirral. The contract will run from 1st April 2013 and will expire on 31.3.2016, with the option to extend, for a period of up to 12 months subject to funding availability, satisfactory service monitoring and confirmation that the service remains in line with Council Priorities.
The Health and Social Care Act 2012 requires that from 1.4.2013 Wirral Council will take over responsibility from NHS Wirral for the provision of an Independent Mental Health Advocacy Service as required under S130A of the Mental Health Act 1983.
The Service will support qualifying patients to understand the legal provisions to which they are subject to under Mental Health Act 1983 and the rights and safeguards to which they are entitled. This could include assistance in obtaining information about any of the following areas, which the Provider must be able to provide and deliver from commencement on the contract.
— provisions of the legislation under which an individual qualifies for an Independent Mental.
Health Advocate.
— any conditions or restrictions an individual is subject to i.e. Section 17 leave,
— medical treatment being given, proposed or being discussed and the legal authority under which this would be given,
— requirements that would apply in connection with the giving of treatment,
— their rights under the Act, how those rights can be exercised and are given the information they need.
The Service will also support qualifying patients to exercise their rights, which may include;
— Supporting patients to access information to better understand what is happening to them,
— Supporting qualifying patients in exploring options, making better informed decisions and actively engage with decisions that are being made,
— Supporting qualifying patients in articulating their own views,
— Speaking on the patients behalf and representing them,
— Supporting patients in other ways to ensure they can participate in the decisions that are made about their care and treatment.
Qualifying patients who reside in Wirral are treated in Wirral and will be the majority of patients who will be seen, however any qualifying patient being treated in Wirral in various establishments will fall under this contract. Individuals being treated outside of Wirral are excluded from this Contract and the Council will make alternative arrangements on a case by case basis.
The IMHA Service will provide high quality advice and representation that is independent of the Council and Mental Health Providers. The Provider will provide support to individuals, whether in the community or in hospital, who are qualifying patients under Section 130C MHA 1983. The Provider will have knowledge of consent to treatment provisions under Section 58 and familiarity with Sections 57, 62, and 63 which also refer to treatment.
The Provider will be responsible in ensuring that all qualifying patients will have access to the IMHA Service and work with all qualifying patients who choose to take up the service. This includes, but is not limited to, people with learning disabilities, dementia, mental health needs, stroke and acquired brain injury.
Although the Service is not being purchased on a unit costs basis this is a demand led service and as such the volume of referrals will fluctuate. Based on previous activity levels it is predicted that future activity will be between 250 – 300 referrals per year and planned service delivery will need to be able to deliver this level of activity. Timeframes for handling of referrals and any subsequent actions must still be adhered to if activity should increase.
The Service Specification requires Providers to have previous experience of working in the Mental Health environment and working with individuals detained under the Mental Health Act 1983. The Advocates it employs will be qualified Independent Mental Health Advocates or in the process of obtaining the relevant qualifications and will do so within 12 months of being appointed. There is an expectation that the successful Provider will adopt any national standards relevant to Independent Mental Health Advocacy and work towards obtaining the Action for Advocacy Quality Performance Mark if not already achieved.
This programme, as with other Council Services, may be affected by the Wirral wide budget consultation exercise. Therefore the final amount available per annum will range between 45 000 GBP to 65 000 GBP. The Council reserves the right to purchase the range and units of Services depending on priorities, funding and demand for Services.
