Provision of insurance and associated services (excluding insurance broking) required by the Council, schools and its affiliated companies. The Council has separate long term agreements in place for its major insurance policies and which are due for renewal on the 29.11.2012.
Insurance Requirements have been divided into lots for the purpose of this contract notice and providers are invited to express an interest in one or more lots.
The Council reserves the right to group the lots for the purposes of requesting insurance proposals and in evaluating final tenders or to award individual lots. The Council may allow proposals and a final tender for all lots grouped together if that would provide the most economically advantageous solution.
Please note the Council reserve the right to not make an award against all lots contained within this notice.
The Council is intending to award services on the basis of a three long term agreement with an option to extend for a further 2 years.

The Council is undertaking a fundamental review of its insurance programme and may change the mix of self-insurance and external insurance cover it procures. The scope of cover includes public and employers liability, property, motor, engineering and fidelity guarantee. The provision of claims handling services will need to be addressed during the dialogue stage and the Council may wish to undertake some or all of this work itself.
This tender opportunity excludes Insurance Broking Services.

Information and formalities necessary for evaluating if the requirements are met: Any supplier may be disqualified who:
(a) is bankrupt or is being wound up, where his affairs are being administered by the court, where he has entered into an arrangement with creditors, where he has suspended business activities or is in any analogous situation arising from a similar procedure under national laws and regulations;
(b) is the subject of proceedings for a declaration of bankruptcy, for an order compulsory winding up the administration by the court or of an arrangement with creditors or of any other similar proceedings under national laws and regulations;
(c) has been convicted by a judgment which has the force of res judicata in accordance with the legal provisions of the country of any offence concerning his professional conduct;
(d) has been guilty of grave professional misconduct proven by any means which the contract authorities can demonstrate;

Information and formalities necessary for evaluating if the requirements are met: This tender is open toeconomic operators who must be licensed to transact insurance services as listed in ii.1.6 above either in theUK or the EC member state of domicile. Economic operators must be an insurance provider authorised andregulated by the UK Financial Services Authority or equivalent in accordance with Articles 45 to 50 of Directive 2004/18/EC and Regulations 23 to 25 of the Public Contracts Regulations 2006 and as set out in the prequalification questionnaire available from the Council via the Chest at the address given in Section I.1.
III.2.2)Economic and financial ability

Information and formalities necessary for evaluating if the requirements are met: (a) appropriate statements from banks or, where appropriate, evidence of relevant professional risk indemnity insurance;
(b) the presentation of balance-sheets or extracts from the balance-sheets, where publication of the balance-sheet is required under the law of the country in which the economic operator is established;
(c) a statement of the undertaking’s overall turnover and, where appropriate, of turnover in the area covered by the contract for a maximum of the last 3 financial years available, depending on the date on which the undertaking was set up or the economic operator started trading, as far as the information of these turnovers is available.
III.2.3)Technical capacity

Information and formalities necessary for evaluating if the requirements are met:
(a) a list of the works carried out over the past five years, accompanied by certificates of satisfactory execution for the most important works. These certificates shall indicate the value, date and site of the works and shall specify whether they were carried out according to the rules of the trade and properly completed. Where appropriate, the competent authority shall submit these certificates to the contracting authority direct;
(c) an indication of the technicians or technical bodies involved, whether or not belonging directly to the economic operator’s undertaking, especially those responsible for quality control and, in the case of public works contracts, those upon whom the contractor can call in order to carry out the work;
(d) a description of the technical facilities and measures used by the supplier or service provider for ensuring quality and the undertaking’s study and research facilities;
(e) where the products or services to be supplied are complex or, exceptionally, are required for a special purpose, a check carried out by the contracting authorities or on their behalf by a competent official body of the country in which the supplier or service provider is established, subject to that body’s agreement, on the production capabilities of the supplier or the technical capacity of the service provider and, if necessary, on the means of study and research which are available to it and the quality control measures it will operate;
(f) the educational and professional qualifications of the service provider or contractor and/or those of the undertaking’s managerial staff and, in particular, those of the person or persons responsible for providing the services or managing the work;
(g) for public works contracts and public services contracts, and only in appropriate cases, and indication of the environmental management measures that the economic operator will be able to apply when performing the contract;
(h) a statement of the average annual manpower of the service provider or contractor and the number of managerial staff for the last 3 years.

The exact requirements of what is being procured will be dependent on the solutions developed by bidders with the Council during the dialogue phase.
All discussions and meetings will be conducted in English and the contract will be subject to English Law. Tenders and all supporting documents must be in English and priced in sterling (GBP).
The Council may accept variant bids in addition to a standard bid as set out in the tender documents provided that the Council’s core requirements are met and provided he variant is submitted in accordance with the tender documents.
Requests to participate must be made by completion and return n of the pre-qualification questionnaire by the date and time specified and in accordance with the instructions set out in the pre-qualification questionnaire.
The pre-qualification questionnaire and a Memorandum of Information are available in electronic format from the Chest Portal.
As part of the dialogue process it is envisaged that a bidder day will be held in August 2012 to which pre-qualified bidders will be invited.
Bidding and bid costs are entirely at the risk of bidders and will not be refunded by the Council under any circumstances. The Council shall not be responsible for any costs, charges or expenses irrespective of the outcome of the competition or if the competition is cancelled or postponed.
All dates and time period specified in this notice are only provisional and the Council reserves the right to changes these. The Council reserves the right to not award any or part of this contract.
Bidders are advised that the contracting authority is subject to the Freedom of Information Act 2000.
