This Framework Agreement will provide the NHS in Scotland and the Scottish Government Health & Social Care Directorate and associated bodies with a comprehensive range of IT Specialist Services to support NHS Scotland’s eHealth Programme; the full details of which have been specified in the descriptions of Lots 1 to 4 of this Contract Notice:
Lot 1 – General IT Specialist Services.
Lot 2 – Management/Business Information Development support.
Lot 3 – IT Integration Specialists.
Lot 4 – Application Development Specialists.
Call off contracts will be let after mini competition, no direct call offs are permitted. Any IPR resulting from work under this framework will require to be owned by the commissioning Health Board and/or the Scottish Government Health & Social Care Directorate. This is a multi-supplier framework by NHS National Services Scotland and may be accessed by other Scottish Health Boards, Special Health Boards and by the Scottish Government Health & Social Care Directorate.

Precise information on deadline(s) for lodging appeals: The Authority will incorporate a ‘standstill period’ of a minimum of 10 clear calendar days, (or a minimum of 15 clear calendar days if the communication method used is not electronic) between the date on which the Authority despatches, to economic operators who submitted a tender or (where no deselection notification has previously been given) applied to be selected to tender, the notice(s) of its decision in relation to the award of a contract (or conclusion of a framework agreement as the case may be) (the “standstill notice”) and the date on which the Authority proposes to conclude the relevant contract or framework agreement. This period allows economic operators in receipt of a standstill notice from the Authority to submit a written request for information in relation to the award process from the Authority before the relevant contract or framework agreement is concluded. In the event that an economic operator submits a written request for information to the Authority within the relevant standstill period, the Authority shall respond to such a request within 15 calendar days of receipt, and in doing so shall provide the following information: (a) for economic operators who did not submit a tender, the reason why that economic operator was unsuccessful; and (b) for a economic operator who submitted a tender, (other than a tenderer which has already received a valid standstill notice from the Authority) the name of the economic operator to be awarded the contract, (or the parties to the framework agreement, if relevant). Such additional information should be requested from the address at section 1.1. Where an economic operator is dissatisfied with the Authority’s response to its request for information, or considers that the Agreement has been concluded in breach of The Public Contracts (Scotland) Regulations 2012, that economic operator is advised to promptly seek independent legal advice. Various different limitations on the time available to raise proceedings may be applicable, depending on the nature of an economic operator’s claim, and the issue in respect of which redress is sought. Time limits for bringing a claim vary from 30 days to 6 months.
