Each lot will be awarded to a single contractor/consortium. Lot 1 will be awarded to up to 3 ranked contractors and Lots 2, 3 and 4 will be awarded to up to 2 ranked contractors. Call-off contracts in each lot will be offered to the first ranked contractor. If the first ranked contractor is unable to deliver the requirements, the client will approach the next ranked contractor and so on until the contract is accepted.

This competition is for Schedule 3 Social and Other Specific Services of the Public Contracts Regulations 2015. Regulations 5(1) (d) and 74 to 76 are applicable. CPD, in its capacity as a Central Purchasing Body, is administering this procurement on behalf of the contracting authority. The contracting authority expressly reserves the right:

(i) to award one, some, all or no lots;

(ii) not to award any contract/framework agreement as a result of the procurement process commenced by publication of this notice or to cancel the procurement at any stage; and

(iii) to make whatever changes it may see fit to the content and structure of the tendering competition and in no circumstances will the authority be liable for any costs incurred by economic operators or candidates. Any expenditure, work or effort undertaken prior to contract award is accordingly at the sole risk of the economic operator or candidate participating in this procurement process. No business whatsoever is guaranteed under any resulting framework agreement or contract indeed there is no guarantee that any framework agreement or contract will be put in place in relation to this notice. No compensation etc will be paid if a contract or framework agreement is withdrawn for any reason. Economic operators should take part in this process only on the basis that they fully understand and accept this position. Contract Monitoring. The successful contractor’s performance on the contract will be regularly monitored. Contractors not delivering on contract requirements is a serious matter. It means the public purse is not getting what it is paying for. If a contractor fails to reach satisfactory levels of contract performance they will be given a specified time to improve. If, after the specified time, they still fail to reach satisfactory levels of contract performance, the matter will be escalated to senior management in CPD for further action. If this occurs and their performance still does not improve to satisfactory levels within the specified period, it may be regarded as an act of grave professional misconduct and they may be issued with a Certificate of Unsatisfactory Performance and the contract may be terminated. The issue of a Certificate of Unsatisfactory Performance will result in the contractor being excluded from all procurement competitions being undertaken by Centres of Procurement Expertise on behalf of bodies covered by the Northern Ireland Procurement Policy for a period of twelve months from the date of issue of the certificate.
