II.1.5)Short description of the contract or purchase(s)

Sheffield City Council is seeking appointment for the provision of legal services in relation to litigation or pre litigation work arising from civil compensation claims for injury, damage or financial loss by third parties and employees which are brought against the Council.
The Council intends to appoint a framework of 3 providers who shall each provide the services to Sheffield City Council at such times as requested in accordance with the Framework Protocol. No previous pattern of appointments shall be taken to have instituted a binding custom or practice and no guarantee of work is offered as part of this arrangement. The period of the appointment will be for 3 years with an option to extend for up to 1 further year.
It is an essential requirement that the Service Provider has a successful and established record of defendant work for the categories of claim for which the service is required which should include work for organisations of a similar size and complexity to the Council.
Sheffield City Council has delegated authority from its liability insurers to handle claims up to 50 percent of the value of its policy deductible and claims above this limit by specific agreement. The current deductible is 250,000 GBP for Public and Employers liability and 25,000 GBP for Third Party Motor.
In addition the Council handles claims relating to its uninsured exposure for claims prior to 1978.
The Council require specialist external legal support to handle, investigate and administer litigated liability and motor claims in line with the Civil Procedure Rules. Some pre-litigated cases will also be delegated to external legal partners dependent on the complexity of the issues of the case or in peak periods of workflow for the internal Claim Handlers.
Successful applicants must be authorised and regulated by the Solicitors Regulation authority.

While the contracting authority cannot guarantee volumes, Sheffield City Council’s overall spend under the contract is estimated to be 212 500 GBP per annum. Over the 4 years (inclusive of Option to Extend period) of the contract Sheffield City Council’s overall spend is therefore estimated to be 850 000 GBP.
It should be noted the number and value of referrals will be influenced by the number and type of claims received during the period of the contract and the above estimate is based on a profile of previous appointments and is subject to variance from external factors during the period of the contract.
In addition to the requirements referenced above directly related to Sheffield City Council, the concluded contract will be open for use by the 22 local authorities within the Yorkshire and Humber region. An estimated upper range value of up to 1,105,000 GBP for the 4 years of the contract (including OTE) has therefore been given to reflect the possibility of other Local Authorities accessing the contract. For the avoidance of doubt, the incremental value generated by the possibilty of the 22 Yorkshire and Humber Local Authorities accessing the contract is estimated to be 30 percent of Sheffield City Council’s total estimated spend, amounting to 255 000 GBP. The total upper range figure of up to 1 105 000 GBP is thereofore based on Sheffield City Council’s estimated spend of up tp 850 000 plus the estimated value of the Yorkshire and Humber Local Authorities at up to 255 000 GBP.
