Building construction work. Assembly and erection of prefabricated structures. Multi-dwelling buildings construction work. Construction work for houses. Houses construction work. Flats construction work. Sheltered housing construction work. Building demolition and wrecking work and earthmoving work. Site preparation work. Building installation work. Building completion work. Foundation work. CHIC and EEM are looking to appoint main (management) contractors to manage the delivery of new homes. The framework will include the management of housing schemes and sites including the erection of homes manufactured off site and delivered to and erected on site including modular homes and homes constructed using frames and panels. Works include the construction of homes utilising brick and block and other on site construction methodologies including, but not limited to, prefabricated floor and roof cassettes and dormers. Projects will involve a range of standard house types including homes, (flats, houses, bungalows etc.) for social / affordable rent, shared ownership, market rent, for outright sale, for a combination of these and other tenures. Projects may include homes and ancillary buildings, which may be retail commercial mixed use or specialist in type or nature. Management contractors will be required to manage all aspects of site construction including, but not limited to, demolition, site infrastructure services, roads, pathways lighting, landscaping, brickwork, roofing, insulation and all other works including but not exclusively first and second fix and internal fit out.
The CHIC and EEM consortia members have requirements predominantly within the Central East and Central West of England and in South & Mid Wales but not exclusively so and may in the future have requirements in other parts of England and Wales. Both consortia are owned by RP’s (Housing Associations, ALMO’s and Local Authorities) and have large scale membership. Both have successfully delivered a range of materials and works contracts for their members over the last 4 years.

Description of particular conditions: Under the Framework Agreements to be awarded at conclusion of the procurement exercise begun by publication of this Contract Notice the successful economic operators appointed and their supply chain will be required actively to participate in the achievement of social objectives relating to participation in skills, development, employment and training programmes in the localities within which the construction of new build housing is to be undertaken (including programmes of targeted recruitment and training) in accordance with the employment and skills strategy documentation contained in the Invitation to Tender which will be issued and to provide other value added contributions in order to support community programs promoted by the Contracting Authority and all Authorised Users (as defined in VI.3 below). Accordingly, contract performance conditions will be included in the Contract(s) to be awarded at conclusion of the procurement exercise begun by publication of this Contract Notice and may relate in particular to secondary considerations in accordance with Regulation 70 of the Public Contract Regulations 2015.

The contracting authority considers that this contract may be suitable for economic operators that are small or medium enterprises (SMEs). However, any selection of tenderers will be based solely on the criteria set out for the procurement, and the contract will be awarded on the basis of the most economically advantageous tender.
This Contract Notice has been published by Central Housing Investment Consortium Limited (“CHIC”) and Efficiency East Midlands Limited (“EEM”) on behalf of their members and the other organisations described below as being Authorised Users. CHIC and EEM are each incorporated as companies limited by guarantee. The Framework Agreements being procured by the procurement exercise begun by publication of this Contract Notice will be entered by CHIC and EEM as the Contracting Authorities which will have undertaken and completed that procurement exercise. Any reference in this Contract Notice to Contracting Authority is deemed to be and include a reference to CHIC and EEM.
CHIC and EEM are combining their separate requirements for the purpose of the procurement exercise commenced by publication of this Contract Notice. CHIC and EEM have jointly appointed Ark Housing Consultancy LLP to conduct the procurement exercise begun by publication of this Contract Notice, but neither organisation will be jointly or severally liable for the other during the conduct of the procurement exercise begun by publication of this Contract Notice and/or under the Framework Agreements to be awarded. CHIC and EEM will award Framework Agreements only in their own name and only on behalf of their own members (Existing, Future, or Participants as defined below).
The current members of CHIC and EEM are detailed in Annexe A. All of the current members are to be regarded as Contracting Authorities under the Public Contracts Regulations 2015 for the purpose of the procurement exercise begun by publication of this Contract Notice and Authorised Users entitled to access and use the Framework Agreements to be awarded at conclusion of the procurement exercise begun by publication of this Contract Notice.
The Authorised Users of the Framework Agreements being advertised by this Contract Notice (in addition to CHIC and EEM) and entitled to access and use the Framework Agreements to be awarded at conclusion of the procurement exercise begun by publication of this Contract Notice are:
1 Any current CHIC and EEM Member — being an organisation which is a member of CHIC or EEM at the date of this Contract Notice and being one of the organisations identified in Annex A; and
2 Any Future Member of CHIC or EEM — being a local authority i.e. County, Metropolitan (City), District, Borough Council or a Unitary Authority in England and Wales, any Arm’s Length Management Organisation (“ALMO”) or any statutory replacement or successor organisation managed by such local authority under a Management Agreement under Section 27 of the Housing Act 1985 (or subsequent legislation) or a Registered Provider (under the Housing and Regeneration Act 2008 or subsequent legislation) (and/or (in the case of EEM) is any NHS Trust or organisation, police authority, fire authority, ambulance trust, university, higher education or further education college or other public sector organisation) and in all cases being an organisation which has applied to join and has joined CHIC or EEM as a member in accordance with the constitutional documents of CHIC or EEM and in respect of which such organisation notice has been given to the economic operators that are a party to the Framework Agreements awarded at conclusion of the procurement exercise begun by publication of this Contract Notice that such organisation is an Authorised User. Future CHIC or EEM Members may include consortia made up of organisations which would themselves individually be a Future CHIC or EEM Member and may include any special purpose vehicle (of whatever nature) owned and controlled by the consortia members and would include in those circumstances the individual consortia members of the special purpose vehicle that own and control that special purpose vehicle; and

Reference to legislation in this Contract Notice includes successor and/or replacement legislation. CHIC and EEM reserves the right not to award any Framework Agreements at the end of the procurement exercise begun by publication of this Contract Notice or to award only part of parts of the proposed works and reserves the right not to award any one or more Lot.
The Authorised Users will have requirements predominantly within the West and East Midlands, East of England, Wales, the South West and South East of England but not exclusively so and may in the future have requirements in other parts of England and Wales. Authorised Users in other parts of England and Wales may also access and use the Framework Agreements to be awarded at conclusion of the procurement exercise begun by publication of this Contract Notice. The successful economic operators may therefore expect the Framework Agreements to be awarded at conclusion of this procurement exercise to be operated and implemented throughout England and Wales.
CHIC and EEM operate a range of existing supply chain arrangements with which successful economic operators will need to interface and will also be required to work with and interface with consultants (Architects, Employers Agents Principal Designers and CDM Advisors) and contractors and OSM suppliers procured as part of the wider CHIC and EEM new build solutions package.
Framework Agreements may be awarded on a multi client as well as a single client basis with the facility for Authorised Users to join both.
Organisations expressing interest and receiving PQQ documents should be aware that TUPE legislation may apply to the arrangements which are being advertised by this Contract Notice (as explained in the PQQ documents); CHIC and EEM for themselves and all Authorised Users express no view or opinion about whether TUPE legislation will or will not apply and all organisations expressing interest in response to publication of this Contract Notice and selected to be invited to tender must take their own legal and other relevant advice at all Stages.
The Lotting Strategy adopted by CHIC and EEM is explained in the procurement documents.
CHIC & EEM reserve the right to amend the procurement documents prior to issuing the ITT for whatever reason and in response to comments and observations received from interested economic operators.
The Call Off Contracts to be awarded pursuant to the Framework Agreements to be entered at conclusion of the procurement exercise begun by publication of this Contract Notice may extend for a duration of up to two years beyond expiry of the four year term of the Framework Agreements.
Economic operators interested in the opportunity being advertised by this Contract Notice should note that a Bidders Day will be held (for those economic operators who have succeeded at PQQ stage) on Wednesday 22nd July 2015 in the morning (exact location and time still to be confirmed). Those economic operators who are successful at PQQ assessment stage will be notified by no later than Monday 20 July 2015 but at this stage all economic operators should note the date and time of the proposed Bidders Day.

Precise information on deadline(s) for lodging appeals: The Contracting Authority will incorporate a minimum ten calendar day standstill period at the point information on the award of the Contract to be awarded at conclusion of the procurement exercise begun by publication of this Contract Notice is communicated to tenderers. The Public Contracts Regulations 2015 provides for aggrieved parties who have been harmed or at risk of harm by breach of those regulations to take action in the High Court (England, Wales and Northern Ireland). Generally, any such action must be brought within thirty days from the date the aggrieved party knew or ought to have known about the alleged breach. Where the contract has not been entered into the court may order the setting aside of the Award Decision or order the Contracting Authority to amend any document and may award damages.
