Scottish Water is seeking to appoint Tier 1 Contractors to support the delivery of its future Quality and Standards IV (Q&S IV) capital investment programme for the regulatory period starting 2015. The two programme areas to be delivered by the Contractors, will include Lot 1: Civil Engineering (across Water Infrastructure, Waste Water Infrastructure and Non Infrastructure) covering, but not limited to, construction projects on Scottish Water Assets, network main replacement and rehabilitation; pipe bursting, slip-lining and mains-laying and minor mechanical and electrical work, and Lot 2: Mechanical and Electrical (across Water Infrastructure, Waste Water Infrastructure and Non Infrastructure) covering, but not limited to maintenance projects, refurbishment and extensions to pumping stations, minor civils construction works and minor works at service reservoirs. Each Lot will require pan Scotland delivery (although Scottish Water reserves the right to award on a geographical basis) and will exclude the Western, Shetland and Orkney Isles. A more detailed description is given in the breakdown of lots in Annex B.
The Contractors are required to act as a Tier 1 provider to Scottish Water’s in-house delivery arm, Scottish Water Managed Delivery, and should be capable of self delivery within one or both Lots. There is no predetermined estimate of the value of work that will be allocated to successful bidders. It is therefore anticipated that the allocation of work will be dependent on the delivery capacity that can be made available by those bidders who are most economically advantageous to Scottish Water.
The Contractors are required to provide expertise, guidance, support and resources in design, planning, management and delivery of Waste Water Infrastructure, Water Infrastructure and Non Infrastructure across Civil Engineering and Mechanical and Electrical work. This may include new assets, renewals, modification, maintenance, refurbishment and extensions to water networks, sewerage networks including UIDs and sewer rehabilitation works, and pumping stations.
Although performance will be continually monitored there will be formal Price and Performance reviews undertaken, aligned with the Water Industry Commission for Scotland (WICS)’s three yearly investment reviews. Subject to satisfactory reviews during the first regulatory period the contract may then be extended at the sole discretion of Scottish Water into the next regulatory period.
It is envisaged that between 5 to 8 Applicants per lot will be invited to tender.

Scottish Water is seeking to appoint a maximum of two Contractors (per Lot) to support Scottish Water Managed Delivery in the delivery of its future Quality & Standards IV (Q&S IV) capital investment programme for the regulatory period starting 2015.
During the regulatory period, Scottish Water is required to deliver specified outcomes which will improve drinking water quality, clean up our environment, provide for new development, and improve customer service. These requirements, which Scottish Water must deliver within the regulatory settlement determined by the Water Industry Commission for Scotland, are set out in a Ministerial Direction to Scottish Water.
The primary objective of the Tier 1 approach is to deliver within a safe environment Scottish Water’s capital investment programme.
The successful Contractors must comply with the mandatory use of Scottish Water’s specialist frameworks including Infrastructure, Kits, Civils Materials and Hires. With respect to design services it should be noted that Scottish Water does not require any Applicants replying to this notice to be tied to a particular consultant for design services. Applicants will be permitted to use designers from their own supply chain provided they meet Scottish Water’s minimum standards.
Estimated value for Lot 1 excluding VAT is in the region of GBP between 9 000 000 – 12 000 000 per annum with a total estimated spend for the first regulatory period in the region of between GBP 54 000 000 – 72 000 000. Prices are based on 2012/13COPI Index.

This contract notice does not preclude Scottish Water from issuing other contract notices for specific requirements from time to time. The contents of this Notice are sufficient for submissions of pre-qualification data all other communications are discouraged. Responses to the OJEU Notice will be evaluated based on Section III.2 and only successful applicants following PQQ evaluation will be invited to submit a tender. Scottish Water reserves the right to divide the scope of the contract into lots at tender and contract award stages as it deems appropriate. Precise information on deadline(s) for lodging appeals: In accordance with regulation 33 of The Utilities Contracts (Scotland) Regulations 2006 as amended (the Regulations) Scottish Water will incorporate a minimum of 10 calendar day standstill period between the communication of the award decision and the decision to enter into the contract with the successful tenderer. A breach of any duty owed under the Regulation is actionable by any economic operator which, in consequence of the breach, suffers, or risks suffering, loss or damage and such proceedings may be brought either the Sheriff Court or Court of Session. Any such action must be brought within 3 months from the date when grounds for the bringing of proceedings first arose unless the Court considers that there is good reason for extending the period within which proceedings may be brought.
