VI.4.2)Lodging of appeals
from the date when the award decision notification is despatched to bidders. This period allows unsuccessful bidders to seek further de-briefing from TRFT before the Contract is entered into. Applicants have until midnight of the second working day of the standstill period for their additional debriefing requests to reach TRFT. A response to such a request must be provided to set aside the award decision before the contract is entered into the bidder by a minimum of 3 working days before the expiry of the standstill period. If an appeal regarding the award of the contract has not been successfully resolved, the Public Contracts Regulations 2006 (SI 2006 No.5) provide for the aggrieved parties who have been harmed, or at risk of harm as a consequence of the breach of the procurement rules to bring an action to the High Court. Any such action must be brought promptly and in any event within 3 months of the date when the grounds of the complaint first arose. Where a contract
has not been entered into, the Court may order the setting aside of the award decision or order TRFT to amend EN Standard form 02 – Contract notice 12 / 16 any document and may award damages. If the contract has been entered into the Court may only award damages. The purpose of the standstill period referred to above is to allow parties to apply to the Court.
