Blackburn with Darwen Borough Council wishes to develop a supplier framework for the supply and distribution of Fresh Milk. The framework agreement is primarily for the use of Educational Establishments and Local Authorities; however suppliers should be aware that this framework agreement will be accessible by UK Public Sector Bodies – including but not limited to Local Authorities, Central Government Departments, NHS Bodies and Police & other Emergency Services (as defined in Article 1(9) of Directive 2004/18/EC and implemented by Regulation 3 of The Public Contracts Regulations 2006) or its agent(s). These include but are not limited to central government departments & their agencies, Non- Departmental Public Bodies (NDPBs), NHS bodies (including; acute trusts, ambulance trusts, primary care trusts, care trusts, NHS hospital trusts, strategic health authorities, mental health trusts, special health authorities), Local Authorities (as defined in Regulation 3(2) to (5) of the Public Contracts Regulations 2006 (‘the Regulations’), Police Authorities (as defined by Regulation 3 (1)(j) to (p) of the regulations), Emergency Services, Educational Establishments (including Schools, Universities, Academies, Colleges) and Registered Social Landlords who have a need to purchase these services. If an appeal regarding the award of a contract has not been successfully resolved, Public Contracts Regulations 2006 (SI2006 No 5) provide for aggrieved parties who have been harmed or are at risk of harm by a breach of the rules to take action in the High Court (England, Wales and Northern Ireland). Any such action must be brought promptly (generally within 3 months).
Where a contract has not been entered into the court may order the setting aside of the award decision or order the authority to amend any document and may award damages. Following the 10 day standstill period, if no further debriefing has been requested, the court may only award damages once the contract has been entered into.
