Participants are advised that the services detailed are a Part B service, this is a voluntary OJEU notice and as such, are not subject to the full application of the Regulations.
The contract will be for a 2 year period with an option to extend on an annual basis for up to a further 2 years. The Council reserves the right not to award any Contract as a result of the procurement process initiated by this notice and will not be liable for any costs incurred by candidates. The Council is using the e-business portal known as THE CHEST (www.the-chest.org.uk). Firms will need to register their details at the following link www.the-chest.org.uk. Once registered, firms will be emailed a log-in and password which will allow firms to gain access to the invitation to tender documents. Firms will need to electronically submit the completed tender submission, qualification questionnaire and any accompanying documentation via the on-line portal by 5pm on 3 June 2013, as referred to in IV.3.4. Any clarification queries must also be submitted via THE CHEST website.

Precise information on deadline(s) for lodging appeals: The Public Contracts Regulations 2006 provide for aggrieved parties who have been harmed or who are at risk of harm by breach of the rules to take legal action. Any such action must be brought within the applicable limitation period. Where a contract has not been entered into, the Court may order the setting aside of the award decision or order the authority to amend any document and may award damages. If the contract has been entered into the Court may, depending on the circumstances, award damages, make a declaration of ineffectiveness, order the authority to pay a fine, and/or order the duration of the contract to be shortened.
