Essex County Council (The Authority) is putting in place an Agreement for Next Generation Network Services for use by or on behalf of public sector and public interest bodies in the East of England. These bodies include but are not limited to:
— Essex and Norfolk* County Councils,
— NHS bodies, including Primary Care Trusts,
— Unitary, District, Borough & Parish Councils,
— the central buying consortium (www.cbconline.org.uk),

— fire & rescue authorities; police authorities,
— educational establishments, both private and public,
— Voluntary Sector Charities,
— and/or other private organisations acting as managing agents or procuring on behalf of these public sector or public interest bodies. Whilst the initial emphasis is on the delivery of services to bodies specifically named above, and to the classes of organisation described above within the County of Essex. *The contract will also be available to Norfolk County Council (save in respect of the procurement of the Wholesale Broadband Network, that is to be procured by Norfolk County Council under the Broadband UK framework Ref OJEU 2011/S 122-202671).

The services to be made available under the Agreement will include provision of Communications Service, Broadband, CCTV and Physical Monitoring Services, Conferencing Services, Managed Equipment Room Services, Call/Contact Centre Services, Wireless, Video, Mobile Voice and data Services, Paging Services, LAN Services, Gateway Services, Unified Services, supporting security, information assurance, design, acquisition, consultancy, and other services as described below.
The Agreement will also be suitable for provision of services that require PSN compliance, and for those at lower security levels, that do not require full PSN compliance.
The services are required to be provided primarily to the Authority, although the Agreement may also be used by other Contracting Authorities in the East of England to service their sites.
The Agreement will have a term of 10 years, with the option to extend for 2 years. During the 10 year period there will be break clauses at years 4, 6 and 8.
The Services are categorised as the following:
— R001 – WAN,
— R002 – LAN,
— R003 – Unified Comms,
— R004 – IP Telephony Fixed line,
— R005 – IP Telephony Mobile,
— R006 – Rural Broadband.

While it is recognised that Essex County Council ’s aim is a single integrated service provision, Essex County Council reserves the right to withdraw one or more of the services from the procurement exercise should Essex County Council deem the services not to offer acceptable quality or value for money to Essex County Council as part of the main requirement. The Services may be phased in or out due to existing Contractual Commitments.
This list detailed in section II.1.5 is not exhaustive and consideration will be given to inclusion of additional services or options for additional services which will assist in delivering a comprehensive Service.
Essex County Council is seeking an innovative Supplier to participate in the agreement, to deliver these services for a period of 10 years with an option to extend for a period not exceeding 2 years in total. However there will be a strategic review of the contract no later than year 4 of the agreement, and the performance of the Agreement will inform the decision regarding the continuation of the Agreement.

Description of particular conditions: Under this contract the successful Bidder will be required to actively participate in the achievement of economic, social and environmental policy objectives relating to recruitment and training, supply chain initiatives and the regeneration of the locality surrounding the place of delivery for the provision of the goods/works and services. Accordingly, contract performance conditions may relate in particular to economic, social and environmental considerations.
The Public Sector equality duty is relevant to this procurement which has a potentially high equality impact and as such the relevant obligations to have due regard to the need to eliminate unlawful disability, gender and race discrimination and to promote equality of opportunity will be passed to the successful Bidder, as well as the specific legal obligations under the Equality Act 2010, which all organisations must comply. Accordingly, contract performance conditions may relate in particular to equality and diversity considerations.

Expressions of interest must be by way of completion and return of the Pre-Qualification Questionnaire (PQQ) by the date and time specified in Section IV.3.4. The Pre-qualification Questionnaire (PQQ) is available via the address specified in section 1.1 (supplier portal) and are available from the 14.3.2012. It is anticipated that the ITT documentation will be published in May, however details of an outline procurement timetable can be found on the Supplier Portal and within the PQQ documentation.
The supplier portal will be used throughout the procurement process, and all communications with Essex County Council relating to this procurement exercise must be via the supplier portal.
The supplier portal has instructions on how to use the system and access the information as well as a helpdesk to assist Bidders.
Essex County Council reserves the right to amend timescales, and change the evaluation criteria if there are genuine omissions or mistakes. We also reserve the right to reduce the number of bidders throughout the Procurement Process. Essex County Council reserves the right to cancel the procurement exercise and/or not to award all or part of a contract. Essex County Council will not be responsible for any costs incurred by suppliers in relation to this procurement exercise.
Suppliers are advised that Essex County Council is subject to the Freedom of Information Act 2000 (FOIA) and the Environmental Information Regulations 2004 (EIR). If a supplier considers that any of the information supplied as part of this procurement exercise should not be disclosed because of its commercial sensitivity, confidentiality or otherwise, it must, when providing this information, clearly identify the specific information it does not wish to be disclosed and clearly specify the reasons for its sensitivity. Essex County Council shall take such statements into consideration in the event that it receives a request pursuant to FOIA or EIR which relates to the information provided by a Supplier.
