II.2.1)Total quantity or scope:

The scope of the contract will cover the full range of contraventions of restrictions on the highway including on-street waiting, loading, parking, permit parking and on-street and off-street pay and display, management of car parks and fixed penalty notices for litter and dog fouling. The service will include on-street patrols, initial notice processing (including postal and telephone payments), provision and support of an integrated IT system for all processing activities associated with parking enforcement and other functions within the operation as and when required – including the option to tow away, remove and dispose of abandoned vehicles.
Two options will be considered as part of this contract:
Option 1 – civil enforcement including on-street patrols and car park management.
Parking enforcement services; car park management; removal and pound operations; on the spot environmental enforcement; pay and display machine management; cash collection services; in car camera enforcement; CCTV enforcement; pay by phone services.
Option 2 – civil enforcement including on-street patrols, car park management and related services.
Parking enforcement services; car park management; removal and pound operations; on the spot environmental enforcement; pay and display machine management; cash collection services; in car camera enforcement; CCTV enforcement; pay by phone services; supply of management information systems; penalty charge notice recovery, processing including permit administration.
The Council will only award either Option 1 or Option 2.
The original contract is for four years with an option to extend for 3 periods of up to one year.

Information and formalities necessary for evaluating if the requirements are met: The Authority will apply all the offences listed in Article 45(1) of Directive 2004/18/EC (implemented as Regulation 23(1) of the Public Contract Regulations (PCR) 2006 in the UK) and all of the professional misconducts listed at Article 45(2) of Directive 2004/18/EC (see also Regulation 23(2) in the PCR 2006) to the decision of whether a Candidate is eligible to be invited to tender.

Candidates will be required to answer these questions as part of the qualification process. For candidates who are registered overseas, you will need to declare if you have any offences/misconduct under your own countries laws, where these laws are equivalent to the Regulation 23 lists.
Candidates who have been convicted of any of the offences under Article 45(1) are ineligible and will not be selected to bid, unless there are overriding requirements in the general interest for doing so.

The Council confirms this requirement is a Part B service and is therefore outside the full ambit of the Public Contract Regulations. The Council is voluntarily advertising this Part B service in the Official Journal in keeping with the spirit of the Public Procurement Regime. This notice is issued so as to increase competition and so that the procurement process is conducted in a fair and open manner. The submission of this notice is not an indication that the Council considers the contract to be a Part A service and accordingly the Council shall not be restricted to those Regulations which are exclusively applicable to Part A services.
Tenderers should note that cashless parking may be introduced by the Council during the course of the contract and therefore the number of PCN’s and use of pay and display machines could be reduced.
Tenderers should note that the council is looking to introduce innovative technologies during the course of the contract in order to reduce the number of civil enforcement Officers and back office costs. The aim is to improve service provision to the public and improve value for money.
The contract is for four years with an option to extend for three periods of up to one year. The value of the contract given in this OJEU Notice, 4 000 000 GBP to 10 500 000 GBP includes the extension periods if taken up and also takes into consideration the award to either Option 1 or Option 2 (at Section ii.2 above), whichever is higher.
The contracting authority considers that this contract may be suitable for economic operators that are small or medium enterprises (SMEs). However, any selection of tenderers will be based solely on the criteria set out for the procurement, and the contract will be awarded on the basis of the most economically advantageous tender.
