Evaluation Process – Quality Threshold.
The overall weighting for evaluation of the Tenders will be on the basis of a price/quality split between the quality criteria at 60 % and price criterion at 40 %.
The Purchasers are keen to maintain high quality standards from all suppliers. Tenders will take the form of a two envelope bid. The envelopes should be marked A and B and should be sealed and put inside your postal envelope/package. Your first envelope should be marked A and should contain all Quality information except for prices (Section 5 Pricing Schedule).
The B envelope will contain price information using Section 5 Pricing Schedule.
The B envelope (price) will only be assessed for tenderers who are within 70 % of the top quality score.
Example: quality score = 85 (top score) x 70 % = 59.5, therefore only suppliers scoring 59.5 or above would progress to have their prices comparatively evaluated.
Tenders which do not meet the quality threshold will be eliminated from the process at this stage and have their price documents returned to them unopened.
The successful tenderer will be that which achieves the highest score in terms of price and quality. In the event of a tie, the tenderer with the lowest price will be identified as the preferred tenderer.
TUPE.
It is anticipated that TUPE may apply to this contract. Tayside Procurement Consortium preliminary view is entirely without prejudice to the responsibility of Tenderers to form their own views on these matters and to take their own independent professional advice. Prospective tenderers will need to satisfy themselves as to whether TUPE applies to this contract in particular in relation to workers presently working for the current Service Provider of the service. If TUPE is applicable the current Service Provider & Prospective Tenderer will be responsible for ensuring compliance and Tayside Procurement Consortium will not accept any responsibility whatsoever with regard to TUPE. Therefore tenderers are strongly advised to seek legal advice regarding TUPE prior to submitting their tender. Please see Appendix 28 of the ITT for information relating to TUPE.

Precise information on deadline(s) for lodging appeals: An economic operator that suffers, or risks suffering, loss or damage attributable to a breach of duty under the Public Contracts (Scotland) Regulations 2006 (SSI 2006/1) may bring proceedings in the Sheriff Court or the Court of Session. Any economic operator that it unsure of its rights here should seek suitable and independent legal advice immediately.
