Scottish Ministers are committed to ensuring that, where practicable and appropriate, sentenced young people under these arrangements who are under the age of 18 are placed in secure accommodation rather than prison. On reaching the age of 18 it is normal practice to transfer the young person to a Young Offenders Institute (YOI). In exceptional circumstances, where there is no place in secure care, young people may still be held temporarily in the prison estate until a place becomes available but this is for the shortest time necessary.
When children and young people are sentenced to detention, the Scottish Tribunals Service and Parole Unit (STS:PU) act on behalf of the Scottish Ministers in directing the location and conditions of their placement in secure accommodation. At present, the STS:PU places sentenced children and young people in 4 secure units in Scotland. There is ongoing monitoring and review of each placement and the education and rehabilitation programme in place for each child.
Scottish Ministers’ responsibilities also include the transportation, under escort, of sentenced children and young people to a secure unit following sentence and as required, for the duration of their sentence.
