VI.4.2)Lodging of appeals

Precise information on deadline(s) for lodging appeals: In accordance with Regulation 47 of the Public Contracts Regulations 2006, the Council will incorporate a
minimum of a 10 calendar day standstill period starting from the date when the award decision notification is
despatched to bidders. This period allows unsuccessful bidders to seek further de-briefing from the Council
before the Contract is entered into. If an appeal regarding the award of the contract has not been successfully
resolved, the Public Contracts Regulations 2006 (SI 2006 No.5) provide for the aggrieved parties who have
been harmed, or at risk of harm as a consequence of the breach of the procurement rules to bring an action to
the High Court. Any such action must be brought promptly and in any event WITHIN 3 months of the date when
the grounds of the complaint first arose. The Court has the power to set aside the award decision and/or the
Contract (if it has been entered into) and may also award damages. The purpose of the standstill period referred
to above is to allow parties to apply to the Court to set aside the award decision and/or the contract (if it has
been entered into) or request for damages to be awarded.
