Inverclyde Council require the services of a Occupational Health Contractor to provide a comprehensive range of occupational health and safety services to the Council and where requested its partnership organisations i.e. Inverclyde Leisure. The volumes specified within the tender will include the potential requirement of any Services provided to partnership organisations. The roles of the Occupational Health Service Contractor includes the provision of advice to the Council management upon which Council management decisions can be made and to provide health and wellbeing support to staff.

Information and formalities necessary for evaluating if the requirements are met: (1) All candidates will be required to produce a certificate or declaration demonstrating that they are not bankrupt or the subject of an administration order, are not being wound-up, have not granted a trust deed, are not the subject of a petition presented for sequestration of their estate, have not had a receiver, manager or administrator appointed and are not otherwise apparently insolvent.
(2) All candidates will be required to produce a certificate or declaration demonstrating that the candidate, their directors, or any other person who has powers of representation, decision or control of the candidate has not been convicted of conspiracy, corruption, bribery, or money laundering. Failure to provide such a declaration will result in the candidate being declared ineligible and they will not be selected to participate in this procurement process.
(3) All candidates will be required to produce a certificate or declaration demonstrating that they have not been convicted of a criminal offence relating to the conduct of their business or profession.

There will be a 2 stage approach to the evaluation of this tender. The selection criteria in Stage 1 will be assessed in accordance with your tender and only those tenderer’s that satisfactorily meet the requirements specfied will proceed to Stage 2 Award Criteria, specifics detailed within the tender documents.
Any award of the contract will be based on the most economically advantageous offer received for each individual lot based on the criteria stated. Inverclyde Council reserves the right to award the contract to one supplier, to award the contract on a shared basis, to award the contract to more than one supplier not accept any offer.
Inverclyde Council also reserves the right to award this Contract in whole or in part.
All submissions should contain 2 paper copies of the completed tender documents & associated appendices,it must be provided in A4 format and printed single sided. Electronic copies of ALL completed tender documents and appendices must also be provided in MS Word/Excel format on a labelled CF and must be enclosed with your tender submission. Tenderers should note if there is a discrepancy in the rates/pricing between hard copy documents and CD disk then rates submitted on the CD disk shall be taken as the tendered rates.

VI.4.2)Lodging of appeals

Precise information on deadline(s) for lodging appeals: Inverclyde Council will incorporate a minimum 10 calendar day standstill period at the point of information on the award of contract is communicated to tenderers. This period allows unsuccessful tenderers to seek further debriefing from the contracting authority before a contract is entered into. Applicants have 2 working days from the notification of the award decision to request additional debriefing and that information has to be provided a minimum of 3 working days before the expiry of the standstill period. Such additional information should be required from the part referred in I.1 hereof. if an appeal regarding the award of the contract has not been successfully resolved, The Public Contracts (Scotland) regulations 2006 (SSI2006 No1) provide for aggrieved parties who have been harmed or are at risk of harm by a breach of the rules to take action in the Sheriff Court or Court of Session. Any such action must be brought promptly (generally within 3 months). Where a contract has not been entered into the Court may order the setting aside of the award decision or order the authority to amend any document and may award damages. If the contract has been entered into the Court may only award damages.
