(a) is bankrupt or is being wound up, where his affairs are being administered by the court, where he has entered into an arrangement with creditors, where he has suspended business activities or is in any analogous situation arising from a similar procedure under national laws and regulations;
(b) is the subject of proceedings for a declaration of bankruptcy, for an order compulsory winding up the administration by the court or of an arrangement with creditors or of any other similar proceedings under national laws and regulations;
(c) has been convicted by a judgment which has the force of res judicata in accordance with the legal provisions of the country of any offence concerning his professional conduct;

The framework period is to be from 1.4.2013 until 31.3.2015 with the option to extend for up to a further 2 years. The Council reserves the right to not award a framework as a result of this procurement process initiated by this notice and will not be liable for any costs incurred by candidates.
Interested parties must submit an invitation to tender by way of expression of interest. The Council is using the e-business portal known as the Chest (www.the-chest.org.uk). Applicants will need to register their details at the following link https://www.the-chest.org.uk/procontract/supplier.nsf/frm_home?openForm.

Once registered, applicants will be emailed a log-in and password which will allow applicants to gain access to the invitation to tender. Applicants will need to electronically submit the completed invitation to tender and accompanying documentation via the on-line portal by 19:00 on 13.12.2012, as referred to in IV.3.4. Any clarification queries must also be submitted via The Chest website. This is a framework to be used by Manchester City Council. Tenderers should note that although quantities and descriptions in the tender are those used and required by Manchester City Council this Framework is open to and may be used by other.

Precise information on deadline(s) for lodging appeals: The Council will incorporate a minimum 10 calendar day standstill period at the point information on the award of the framework is communicated to tenderers prior to entering into the framework. If an appeal regarding the award of a framework has not been successfully resolved the Public Contracts Regulations 2006 (SI2006 No 5) provide for aggrieved parties who have been harmed or are at risk of harm by a breach of the rules to take action in the High Court (England, Wales and Northern Ireland). Any such action must be brought promptly (generally within 3 months). Where a contract has not been entered into the court may order setting aside of the award decision or order the authority to amend any document and may award damages. If the contract has been entered into the court may award damages and/or shorten or order the contract ineffective.
