The Scope of Service
The City of Edinburgh Council seeks to commission a Quantity Surveying consultancy service to support its 21C Homes for Edinburgh Programme. This will be in the form of a single supplier awarded contract from which services may be called off.
The consultant may be required to provide professional support for the life time of the 21st Century Homes programme.
This eight year contract will be subject to annual review which will be based on performance measures and best value. It is intended that these services shall cover projects within the 21st Century Programme which will vary in size and nature, but generally are likely to individually exceed 5m.
The current portfolio consists of, but not limited to, the following projects:-
North Sighthill site, currently comprising the construction of c320 mixed tenure homes on a masterplanned 4.5ha site.
Pennywell mixed tenure housing development of c700 homes over a period of 8 years, managed within a development agreement.
The scope of professional services envisaged is detailed below. It is accepted that additional services may be required during the currency of this contract, for which a tendered hourly rate will be applied.

Information and formalities necessary for evaluating if the requirements are met: (1) All candidates will be required to produce a certificate or declaration demonstrating that they are not bankrupt or the subject of an administration order, are not being wound-up, have not granted a trust deed, are not the subject of a petition presented for sequestration of their estate, have not had a receiver, manager or administrator appointed and are not otherwise apparently insolvent.
(2) All candidates will be required to produce a certificate or declaration demonstrating that the candidate, their directors, or any other person who has powers of representation, decision or control of the candidate has not been convicted of conspiracy, corruption, bribery, or money laundering. Failure to provide such a declaration will result in the candidate being declared ineligible and they will not be selected to participate in this procurement process.

Precise information on deadline(s) for lodging appeals: A tenderer that suffers loss as a result of a breach of duty under the Public Contracts (Scotland) Regulations 2006 may bring proceedings in the Sheriff Court or the Court of Session. The City of Edinburgh Council (CEC) will have a minimum standstill period of 10 days before awarding the contract. The communication of the award decision notice will be sent by fax or e-mail to all tenderers on day 1 of the standstill period. If proceedings are started in the Sheriff Court or the Court of Session against CEC in respect of the decision to award the contract within the standstill period then CEC is prevented from awarding the contract. Post contract award the Sheriff Court or the Court of Session may (1) award damages provided proceedings are brought within 3 months from the date when the grounds for the bringing of the proceedings first arose (2) be entitled to issue an ineffectiveness order or impose a financial penalty on CEC. A claim for an ineffectiveness order must be made within 30 days of the Contract Award Notice being published in the OJEU or within 30 days of the date those who expressed an interest in or otherwise bid for the contract were informed of the conclusion of the contract or in any other case within 6 months from the date on which the contract was entered into.
