Intelligence, Surveillance, Target Acquisition and Reconnaissance. Dismounted Soldier Systems Project Team (DSS PT), part of the Ministry of Defence, intends to place an amendment to the current HMNO repair contract DSS/00024 with Sensor Technology Systems Ltd (STS) for certain services namely obtaining military equipment – additional Left/Right Hand Monoculars for the repair of the Head Mounted Night Optics (HMNO-5855-01-495-1111. These services need to have been provided in the UK by 30 April 2012.
The HMNO sight was procured competitively in June 2001 from STS (sole approved UK Agent for O’GARA Group US). O’GARA Group is the OEM and the Design Authority for the HMTS sight.
The HMNO sights thus procured have been since used in combat and further such use is expected in the foreseeable future. Unfortunately the damage rate has been higher than expected and the MoD needs more Monoculars to repair HMNO sights bought under DSS/00024. The services required cannot for technical and economic reasons be separated from those under the exisitng contract without major inconvenience to the MoD. It is confirmed that the value of the envisaged additional contract would be fewer than 50 % of the cost of DSS/00024.
It is therefore considered that this contract amendment can be placed using negotiated procedure without prior publication pursuant to Article 28 (4) (a) (i) of Directive 2009/18/EC (Regulation 16 (1) (d) (i) (aa) of the UK Public Contracts Regulations 2011.
