Justification for a framework agreement, the duration of which exceeds four years: Due to the technical complexities of this contract it is not economically viable to have a period of less than 5 years.

It is envisaged that the network will be based on a solution using the most appropriate and suitable infrastructure for Blackpool Council and will need to include some or all of the following components:
Existing Council owned infrastructure,
Local loop unbundling (LLU) technology.
Private fibre infrastructure.
Radio communications technology.
Service from other telecommunications operator in the town such Virgin Media or BT.
The tender is intended to enable Blackpool Council to select a suitable partner to assist them with the design, development, delivery and management of a new and existing wide area network. It is the Councils preference that the successful solution will, where possible and where cost effective, be owned by Blackpool Council with minimal involvement of a partner who will provide designated Communications Provider functions, ongoing network management/billing support plus options for first, second and third line support (including training for Blackpool Council IT staff members).

Section III: Legal, economic, financial and technical information
Description of particular conditions: As stated in the Invitation to Tender Documentation.
(1) An extract from the ‘judicial record’ or equivalent issued by the legal or administrative authority of the country of origin, by a declaration on oath or by a solemn declaration made before a competent judicial or administrative authority, a notary or a competent professional or trade body, demonstrating that the bidder:
a) is not bankrupt or being wound up, its affairs are not being administered by the court, it has not entered into an arrangement with creditors, it has not suspended business activities or is not in any analogous situation arising from a similar procedure under national laws and regulations;
(b) is not the subject of proceedings for a declaration of bankruptcy, or for an order for compulsory winding up or administration by the court or for an arrangement with creditors or of any other similar proceedings under national laws and regulations;
(c) has not been convicted of an offence concerning his professional conduct by a judgment which has the force of res judicata (i.e. a matter which has already been conclusively decided by a court).
(2) A certificate issued by the competent authority in the Member State concerned, or a declaration on oath or by a solemn declaration made before a competent authority, a notary or a competent professional or trade body, to the effect that the bidder has fulfilled its obligations relating to the payment of taxes and social security contributions in accordance with the legal provisions of the country in which the bidder is established.
(3) A certificate, declaration under oath, or solemn declaration providing proof that the bidder is enrolled on the professional or trade registers of his country of establishment, or where no such register exists a declaration under oath or solemn declaration that he exercises the particular profession or trade.

Section IV: Procedure
Justification for the choice of accelerated procedure: Justification for the choice of accelerated procedure: There is a perceived economical advantage to be gained through rapid execution of the contract, in accordance with the EU’s fundamental aims of boosting the economy through shortened procurement timescales. It is anticipated that extensive planning will be required to ensure the continuation of IT services when the existing Virgin Media Contract expires at the end of March 2013, Walter Robinson Court that currently provides approximately 25 sites of connectivity is demolished and Blackpool Council moves to its new building in the New Central Business District of Blackpool Town Centre therefore the time available to implement the new contractual arrangement is short.
