Provision of Residential Care and/or Residential Education Services and Day Education Services for Looked After Children, those at risk of becoming Looked After, those with or without an Identified Special Educational Need.
The Council invites interested provider organisations to apply to join a rolling select list from which the Council will conduct a series of further procurement exercises involving organisations on the list.
Services must be provided from establishments located within the geographical boundaries of the following Local Authorities.
Norfolk, Suffolk, Cambridge, Essex, Thurrock, Southend, Luton, Peterborough, Lincolnshire, Central Bedfordshire, Rutland, Bedford, Hertfordshire, North Lincolnshire, North East Lincolnshire.

The Procurement exercises undertaken by the Council will be for spot contracts for individual service users, however the Council may in the future elect to invite only those Provider on the Rolling Select List to compete for block contracts. The Contract(s) will be for 3 years with an option to extend for 2 years on a 1 plus 1 basis.

This is a procurement for services specified in Part B of Schedule 3 of the Public Contracts Regulations 2006 (“Part B services”). Accordingly, and not withstanding the advertising of this procurement exercise in the Official Journal, the Public Contracts Regulations 2006 (as amended) only apply in part. The procurement exercise will be conducted in accordance with the information contained in the contract documents.
The Authority has voluntarily advertised this procurement exercise in the Official Journal, solely in order to reach as wide an audiance as possible. The Authority has been constrained by the forms used by the Publications Office to describe the procurement as “Open”. This will be a one-stage procurement process, but the authority does not bind itself to conduct the procurement in accordance with the Open Procedure, as described in the Regulations, nor to abide by any other part of the Regulations which does not expressly apply to procurements for Part B services.

Precise information on deadline(s) for lodging appeals: The Council has voluntarily decided to in corporate a standstill period at the point when information on the proposed award of the contract is communicated to tenderers. The standstill period, which will be for a minimum of ten calendar days, provides time for unsuccessful tenders to challenge the award decision before the Contract is entered into. Aggrieved parties who have been harmed or are at risk of harm by any breach of the
Council’s obligations may take action in the High Court (England, Wales and Northern Ireland).
Proceedings must be brought within 30 days from the date of knowledge (the date on which the economic operator first knew or ought to have known that grounds for starting the proceedings had arisen) unless the Court considers that there is good reason for extending the period within which proceedings may be brought, in which case the Court may extend that period up to a maximum of 3 months from the date of knowledge.
