Information and formalities necessary for evaluating if the requirements are met: Any consultant may be disqualified who:
A) is bankrupt or is being wound up, whose affairs are being administered by the court, who has entered into an arrangement with creditors or who is in any analogous situation arising from a similar procedure under national laws and regulations;
B) is the subject of proceedings for a declaration of bankruptcy, for an order for compulsory winding-up or for an arrangement with creditors, or is the subject of any other similar proceedings under national laws and regulations;
C) has been convicted of an offence concerning his/her professional conduct by a judgement which as a force of res judicta;
D) has been guilty of grave professional misconduct proven by any means which the contracting authorities can justify;
E) is guilty of serious misrepresentation in supplying the information required under the provisions of the Directive on the criteria for qualitative selection;
F) has not fulfilled obligations relating to the payment of social security contributions in accordance with the legal provision of the country in which he/she is established or those of the country of the contacting authority;
G) has not fulfilled obligations relating to the payment of taxes in accordance with the legal provisions of the country in which he/she is established or those of the country of the contracting authority.
Consultants must also provide the certificate of enrolment on the professional or trade register under the conditions laid down by laws of the Member state in which he is established for instance on the Register of Companies in the United Kingdom & Ireland.

III.2.2)Economic and financial ability

Information and formalities necessary for evaluating if the requirements are met: All candidates will be required to:
A) provide a reference from their bank;
B) submit the firm’s balance sheets or extracts from, where publication of a balance sheet is required under company law;
C) provide a statement of the firm’s overall turnover and its turnover in respect of the service to which the contract relates for the previous 3 financial years;
D) provide a copy of the most recently published company report and accounts, to be included as an appendix to the submission document;
E) provide evidence of relevant professional risk indemnity insurance.

III.2.3)Technical capacity

Information and formalities necessary for evaluating if the requirements are met:
Applications are requested only from companies who can meet the following minimum criteria:
1) demonstrate that their core business is the provision of the service for which they are tendering;
2) prove recent relevant experience of work of this nature and value;
3) operate a quality assurance system to at least BS/EN/ISO 9000 or equivalent alternative.
Expressions of interest: companies who are able to satisfy the above minimum criteria should express their interest by providing one hard copy at A4 size and one electronic copy of the following information:
A) company capability: copies of published corporate literature describing the company and its services and a capability statement of the office or division proposing to carry out the services;
B) relevant experience: references should be provided with names and contact details for projects of a similar status and value completed in the last three years;
C) company structure: details of relationships to subsidiary parent associate and ultimate holding company as applicable;
D) company resources: list of personnel employed by the office or division proposing to carry out the services, also an indication of the proportion of the contract which the company intends possibly to subcontract;
E) proof of legal position: documentation as described in section III.2.1;
F) financial statements: documentation as described in section III.2.2;
G) quality statement: a copy of the company’s policy statement, most recent certificate of registration and details of how this is implemented on projects;
H) safety statement: a copy of the company’s policy and details of how this is implemented on projects;
I) industrial relations statement: a copy of the company’s policy and details of industrial relations issues (positive or negative) over the past 5 years;
J) environmental statement: a copy of the company’s policy and details of how this is implemented on projects.

Precise information on deadline(s) for lodging appeals: Royal Academy of Arts will incorporate a standstill period at the point which information on the award of the contract is communicated to tenderers. The standstill period, which will be for a minimum of 10 calendar days, provides time for unsuccessful tenderers to challenge the award decision before the contract is entered into.
