Description of the goods or services requiredThe Scottish Government committed to undertake a comprehensive review of the agricultural holdings legislation within 18 months from the date on which the Agricultural Holdings (Amendment) (Scotland) Act 2012 became law (12 September 2012). During the passage of the Agricultural Holdings Bill 2011, through the Scottish Parliament there was agreement on an urgent need for better information on trends in tenure of agricultural holdings, including investigation of the reasons behind the steady decline in the number of agricultural tenancies in recent years. Information is also required on related landlord and tenant farmer issues such as rent reviews; dispute resolution; succession and pension issues; waygo arrangements; issues around farm diversification and fixed equipment. More recently the Cabinet Secretary for Rural Affairs and the Environment has announced that Absolute Right to Buy (ARTB) will now be considered as part of the Review of the Agricultural Holdings Bill, and this consideration will be restricted to 1991 tenancies. Evidence is therefore required around the views and experiences of landlords on these matters. Landlord/tenant relations has been a politically sensitive issue for many years and it is imperative that all documents, including the tender, are carefully and neutrally worded. It is more important that the contractor has excellent professional standards in designing, conducting and reporting surveys than having in-depth knowledge in the subject matter itself. The final report should be a robust, independent, neutral, factual analysis of the survey responses. A corresponding survey of tenant farmers will be contracted and implemented over a similar time period.
