II.1.5)Short description of the contract or purchase(s)

Northamptonshire County Council, on behalf of LGSS members, wishes to appoint a single operator to a framework for the provision of ad hoc and planned security services. Northamptonshire and Cambridgeshire County Council’s work together in partnership under the name of LGSS. LGSS is a shared services venture established under the Local Government Act 1972. Although it is anticipated that Northamptonshire County Council will be the primary customer for this framework is also open to:
(i) all LGSS existing and/or future partners and other organisations delegating services and/or functions to LGSS (currently Cambridgeshire County Council, Northamptonshire County Council and Norwich City Council) who participate in the LGSS shared services venture;
(ii) customers of LGSS,
(iii) to any city, district and/or borough local authorities within the county of Northamptonshire and/or Cambridgeshire; and
(iv) any company and/or organisations set up by Northamptonshire and/or Cambridgeshire County Council (including Olympus Care Services).
The services to be provided under the contract include the following:
Key Holding.
Helpdesk provision (including out of hours).
Mobile Patrols with / without dog.
Static Guarding with / without dog reactive Emergency Response calls boarding up and securing sites.
Public Space Surveillance (CCTV monitoring).
The individual requirements for both the planned services at relevant sites and the reactive element will be specified at ITT stage and will be priced according to a Schedule of Rates agreed as a result of this tender process. The contract will be for a period of two years, with no option to extend, commencing 1.6.2013.
TUPE is likely to be applicable under this contract. Full details will be provided at ITT stage. TUPE stands for ‘Transfer of Undertakings (Protection of Employment)’ and Bidders should be aware that the Council has a current arrangement with an existing contractor for security services. Therefore, the existing contractor will be under obligation to declare any employees who may be protected by TUPE legislation and may be liable to transfer.

VI.4.2)Lodging of appeals

Precise information on deadline(s) for lodging appeals: LGSS will incorporate a standstill period at the point information on the award of the contract is communicated to tenderers. The duration of this standstill will be disclosed at this point. This period allows unsuccessful tenderers to seek further debriefing from the contracting authority before the contract is entered into. Such additional information should be required from (Refer to address in part 1.1) If an appeal regarding the award of a contract has not been successfully resolved the Public Contracts Regulations 2006 (SI 2006 No 5) provide for aggrieved parties who have been harmed or are at risk of harm by a breach of the rules to take action in the High Court (England, Wales and Northern Ireland). Any such action must be brought promptly. Where a contract has not been entered into the Court may order the setting aside of the award decision or order the authority to amend any document and may award damages.
