MCC is now seeking a new arrangement with an innovative media owner to modernise the provision of the FSU structures, through a rationalisation and digitisation programme.

Manchester City Council (MCC) currently operates a City Centre wide Free-Standing Unit (FSU) contract for the provision of FSU structures on MCC controlled public highway incorporating advertising display panels within Manchester city centre. MCC is now seeking a new arrangement with an innovative media owner to modernise the provision of the FSU structures, through a rationalisation and digitisation programme. This is a competitive procedure with negotiation tender process and any interested party may tender. Invitations to Tender (ITT) will be issued to the top 4 highest scoring submission at the Request to Participate (RtP) who have also met all other criteria following evaluation of supporting evidence:
MCC (the Authority) reserve the right to:
(i) award this contract on the basis of the initial tender without negotiation;
(ii) negotiate in successive stages in order to reduce the number of tenders to be negotiated by applying the award criteria specified in the ITN.
The contract will be awarded for an initial term of 10 years commencing 1 January 2021, with an option to extend for up to an additional 5 years.
The contract will be a service concession contract pursuant to the Concession Contracts Regulations 2016 and Directive 2014/23/EU of the European Parliament and of the Council.
The indicative value over the maximum term for each lot is based upon the estimated annual turnover of the operator.
The contracting authority expressly reserves the right not to award any contract as a result of the procurement process commenced by publication of this contract.
In no circumstances will the contracting authority be liable for any costs incurred by the candidate and any expenditure, work or effort undertaken prior to contract award is accordingly a matter solely for the commercial judgement of potential suppliers.
The Council is using the e-business portal known as The Chest www.the-chest.org.uk to conduct the procurement exercise. To gain access to the invitation to tender documents, tenderers will need to register their company details at the above website.
Once registered, tenderers will be emailed a log-in and password which will allow them to gain access to the invitation to tender documents.
Tenderers will need to electronically submit their completed tender documents and accompanying documentation via the Chest on-line portal by 11 a.m. on Monday the 13 April 2020. Any supplier questions queries will also need to be submitted via The Chest website.

The Council will incorporate a minimum 10 calendar day standstill period at the point information on the award of the contract/framework is communicated to tenderers prior to entering into the contract/framework. If an appeal regarding the award of a contract/framework has not been successfully resolved, the Public Contract Regulations 2015 provide for aggrieved parties who have been harmed or are at risk of harm by a breach of the rules to take action in the High Court (England, Wales and Northern Ireland).
